24-1483 - 8458-1 - Ordinance ExecutedORDINANCENO. 24-1483 AN ORDINANCEOF THE CITY OF DENTON, A TEXAS HOME-RULEMUNICIPAL CORPORATION,AUTHORIZING THE CITY MANAGER TO EXECUTEA CONTRACT WITH TEXASCEMETERYRESTORATIONLLC, FORGROUNDPENETRATINGRADAR, GPS/GIS SURVEYINGAND MAPPING,AND MONUMENTREPAIRFORTHEIOOFAND OAKWOOD CEMETERIES FORTHE PARKS AND RECREATION DEPARTMENT; PROV[DING FORTHE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN EFFECTIVE DATE (RFP 8458-1– AWARDED TO TEXASCEMETERY RESTORATIONLLC, FORONE(1) YEAR, WITH THE OPTION FORFOUR (4) ADDITIONAL ONE (1) YEAR EXTENSIONS, IN THE TOTAL FIVE (5)YEAR NOT-TO-EXCEED AMOUNT OF $500,000.OO). WHEREAS, the City hassolicited, received, and evaluatedcompetitive proposals for ground penetratingradar, GPS/GIS surveying and mapping, and monument repair for the IOOF and Oakwood Cemeteriesfor the Parksand Recreation Department; and WHEREAS, the City Manager,or a designatedemployee,has received, reviewed, and recommendedthat the herein described proposals arethe most advantageous to the City considering the relative importance of price and the other evaluation factors included in the requestfor proposals; and WHEREAS, this procurementwas undertaken aspart of the City’s governmentalfunction;and WHEREAS,theCity Council hasprovidedintheCity Budgetfortheappropriationof funds to beusedfor the purchaseof the materials, equipment, supplies, or services approved and accepted herein;NOW,THEREFORE, THE COUNCIL OFTHE CITY OFDENTON HEREBY ORDAINS: SECTION 1. The items in the following numbered request for proposal for materials, equipment, supplies, or services shown in the “Request Proposals” on file in the office of the PurchasingAgent, arehereby acceptedand approved asbeing the most advantageousto the City consideringthe relative importanceof price andthe otherevaluation factors included inthe request for proposals. RFP NUMBER CONTRACTOR AMOUNT 8458- 1 Texas Cemetery Restoration LLC $500,000.00 SECTION 2. That by the acceptanceandapproval of the abovenumbereditems ofthe submitted proposals,the City acceptsthe offer of the personssubmitting the proposalsfor such items andagreesto purchase the materials, equipment, supplies, or services in accordance with the terms, specifications, standards, quantities, and for the specified sums contained in the Proposal Invitations, Proposals,and related documents. SECTION 3. That should the City andperson submitting approved and accepted items wish to enter into a formal written agreement asaresult of the acceptance, approval, and awarding of the proposals, the City Manager, or their designated representative, is hereby authorized to execute the writtencontractwhich shallbeattachedhereto;provided thatthewritten contractis in accordance with the terms, conditions, specifications, standards, quantities, and specified sums contained in the Proposalandrelateddocumentsherein approved and accepted. SECTION4. The City Council of the City of Denton herebyexpresslydelegatesthe authorityto take any actionsthat may be required or permittedto be performed by the City of Denton underthis ordinanceto the City Manager of the City of Denton, or their designee. SECTION 5. By the acceptanceand approval of the above enumeratedbids, the City Council herebyauthorizesthe expenditure of funds therefor in the amount and in accordancewith theapprovedbids. SECTION 6. This ordinanceshall becomeeffective immediately upon its passageand approval.
