Exhibit 1 - Agenda Information Sheet City of Denton AGENDA INFORMATION SHEET DEPARTMENT: Procurement ACM: Cassey Ogden DATE: October 22, 2024 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager to execute a Professional Services Agreement with Freese and Nichols, Inc., for regulatory permitting, process evaluation, and design services for the Ray Roberts Water Treatment Plant Expansion Project for the Water Utilities Department as set forth in the contract; providing for the expenditure of funds therefor; and providing an effective date (RFQ 7574-029 – Professional Services Agreement for regulatory permitting, process evaluation, and design services awarded to Freese and Nichols, Inc., in the not-to-exceed amount of $21,000,000.00). The Public Utilities Board recommends approval (6 - 0). STRATEGIC ALIGNMENT This action supports Key Focus Area: Enhance Infrastructure and Mobility. INFORMATION/BACKGROUND The Ray Roberts Water Treatment Plant (RRWTP) was constructed and placed into service in 2002, with a capacity of 20 million gallons per day (MGD). There is a need to expand the treatment capacity at the RRWTP. With the continued residential, commercial, and industrial growth experienced in the City of Denton, the City desires to expand the capacity of the RRWTP to approximately 40 MGD through the design and construction of a parallel membrane process train. The anticipated initial capacity of the membrane process train will be 20 MGD with space reserved for modular expansion for a total of 50 MGD at full build-out of the membrane building designed for this Project. The proposed expansion of RRWTP will include: • Treatment train that will utilize low-pressure membrane units • New parallel raw water pipeline • New pre-ozone contactor • New pump diffusion vault and flow separator • New flocculation/sedimentation basins • New membrane feed pump station • New intermediate ozone contactor • New biologically active filters • New transfer pump station • Construction of an additional clearwell City Hall 215 E. McKinney Street Denton, Texas www.cityofdenton.com Prior to the design phase, the consultant will be required to perform a pilot study for the low-pressure membrane filters to comply with the Texas Commission on Environmental Quality (TCEQ) requirements for innovative treatment technologies. Additionally, the consultant will need to evaluate the existing raw water supply and flow split, solids handling, and incoming electrical power supply and distribution infrastructure. To achieve the goal of completing the RRWTP Expansion, City Staff evaluated the use of a Construction Manager at Risk (CMAR), an alternative delivery method that will make project delivery more efficient. This delivery method leans heavily on collaboration among the City, the design engineer, and the CMAR during the design process to allow for the best schedule coordination, cost modeling, and community engagement. By utilizing this methodology, the staff’s goal of construction sequencing to mitigate increasing costs, prepurchase equipment to plan for long lead times, and gain overall cost value will be prioritized. The current total opinion of probable design and construction costs for this project is approximately $195,845,000. Staff evaluated the qualifications and ability of Freese and Nichols to complete this critical infrastructure project. Based upon the firm’s experience and staff assigned to the project staff have determined that Freese and Nichols are highly qualified to perform this work. Request for Qualifications for professional engineering services for Water and Wastewater was solicited using the City’s formal solicitation process. City Council approved a pre-qualified list of engineering firms on March 23, 2021 (Ordinance 21-546). PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On March 23, 2021, the Council approved RFQ 7574 for a prequalified list of professional engineering services firms (Ordinance 21-546). On October 14, 2024, the Public Utilities Board (PUB) recommended this item to the City Council for consideration. RECOMMENDATION Award a contract with Freese and Nichols, Inc., for regulatory permitting, process evaluation, and design services for the Ray Roberts Water Treatment Plant Expansion Project for the Water Utilities Department, in a not-to-exceed amount of $21,000,000. Denton, TX ESTIMATED SCHEDULE OF PROJECT The RRWTP Expansion project will be started upon approval of the design and CMAR contracts with a projected construction completion date of Q4 2029. FISCAL INFORMATION These services will be funded from Water Utilities account 635179523.1360.21100. Requisition #165657 has been entered into the Purchasing software system in the amount of $20,000,000. The remaining funds will come from the Fiscal Year 24/25 budget. The budgeted amount for this item is $21,000,000.
