AN ORDINANCEOF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICiPAL
CORPORATION,AUTHORIZING THECITY MANAGER TOEXECUTEA CONTRACT WITH
FLOW-LfNECONSTRUCTION,INC., FOR THE CONSTRUCTIONOF THE GRANADA
SANITARY SEWERIMPROVEMENTSAND LIFT STATION DECOMMISSIONINGPROJECT
FORTHE WATER UTILITIES DEPARTMENT; PROViDING FORTHE EXPENDITURE OF
FUNDSTHEREFOR;AND PROVIDINGAN EFFECTIVEDATE (CSP8573–AWARDED TOFLOW-LTNE CONSTRUCTION, INC., IN THE NOT-TO-EXCEED AMOUNT OF
$1 ,487,590.50).
WHEREAS, the City hassolicited, received,andevaluatedcompetitiveproposals for the
constructionof the GranadaSanitary Sewer Improvementsand Lift Station Decommissioning
Project for the Water Utilities Department; and
WHEREAS, the City Manager,or a designatedemployee, hasreceived, reviewed, and
recommended that the herein described proposals arethe most advantageousto the City considering
therelative importanceof price andthe other evaluation factors included in the competitive sealed
proposals;and
WHEREAS, this procurementwas undertakenaspartof the City’s governmental
function [Health and sanitationservices]; and
WHEREAS,theCity Councilhasprovidedin theCity Budgetfortheappropriationof funds
to beusedfor the purchase of the materials, equipment, supplies, or services approved and accepted
herein;NOW,THEREFORE,
THECOUNCILOFTHE CiTY OFDENTON HEREBY ORDAINS:
SECTION 1. The items in the following numberedcompetitivesealedproposalfor
materials, equipment, supplies, or services shown in the “Competitive Sealed Proposals“ on file in
the office of the PurchasingAgent,are herebyacceptedand approvedasbeing the most
advantageousto the City considering the relative importance of price and the other evaluation factors
included in the competitive sealedproposai.

SECTION2. Thatby the acceptanceand approval of the abovenumbereditems ofthe
submitted proposals, the City acceptsthe offer of the personssubmitting the proposalsfor such items
andagreesto purchasethe materials, equipment, supplies, or services in accordance with the terms,
specifications, standards,quantities, and for the specified sumscontained in the Proposal Invitations,
Proposals,and related documents.
SECTION 3. That should the City and person submitting approved and accepted items wish
to enter into aformal written agreement asa result of the acceptance, approval, and awarding of the
proposals, the City Manager, or their designated representative, is hereby authorized to execute the
written contract which shall be attachedhereto; provided that the written contract is in accordance
with the terms, conditions, specifications, standards, quantities, and specified sums contained in the
Proposal and related documents herein approved and accepted.
SECTION 4. The City Council of the City of Denton hereby expressly delegatesthe
authorityto take any actionsthat may be requiredor permittedto be performed by the City of
Denton underthis ordinanceto the City Manager of the City of Denton, or their designee.
SECTION5. By the acceptanceandapprovalof the aboveenumeratedbids, the City
Council herebyauthorizesthe expenditure of funds therefor in the amount andin accordancewith
theapprovedbids.
SECTION 6. This ordinanceshall becomeeffective immediateiy upon its passageand
approval.
