Exhibit 1 - Agenda Information SheetCity of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement ACM: Cassey Ogden DATE: November 19, 2024 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager to execute a contract with Whirlix Design, Inc., through the Buy Board Cooperative Purchasing Network Contract No. 679-22, for the construction of a playground and shade at Biddy Bye Park for the Parks and Recreation Department; providing for the expenditure of funds therefor; and providing an effective date (File 8663 – awarded to Whirlix Design, Inc., in the not-to-exceed amount of $279,173.00). STRATEGIC ALIGNMENT This action supports Key Focus Area: Strengthen Community and Quality of Life. INFORMATION/BACKGROUND In March 2022, City Council approved Ordinance 21-2143, which authorizes the City Manager to enter into a Development Agreement with First Texas Homes Inc., the developer of 156 residential lots, known as Parkside. The agreement terms included the dedication of land for one (1) lot of 17.998 acres for Public Park use and one (1) lot of 4.883 acres as a city public lot. In addition, First Texas is responsible for the partial construction of the park, while Parks is responsible for coordinating the installation of the playground. In December 2022, City Council authorized several park renaming applications, which included changing Parkside Property to Biddy Bye Park (Ordinance 22-2445). This contract includes the City’s obligation of the agreement by purchasing and installing the following items: • Two (2) to five (5) year & five (5) to twelve (12) year-old playground structures • Integrated shade over the new playground Purchase & Installation: Playground $288,486.00 Buy Board 5% Discount ($14,424.00) Performance & Payment Bonds $5,111.00 Total $279,173.00 As a playground’s life span is typically 15-years, this playground has been added to the Playground Replacement Plan for 2039. McKinney Street Denton, Texas www.cityofdenton.com Pricing obtained through the Buy Board Cooperative Purchasing Network has been competitively bid and meets the statutory requirements of Texas Local Government Code 271.102. PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On February 1, 2005, City Council approved the interlocal agreement with the Buy Board Cooperative Purchasing Network (Ordinance 2005-034). RECOMMENDATION Award a contract with Whirlix Design, Inc., for the construction of a playground and shade at Biddy Bye Park for the Parks and Recreation Department, in the not-to-exceed amount of $279,173. PRINCIPAL PLACE OF BUSINESS Whirlix Design, Inc. Richardson, TX ESTIMATED SCHEDULE OF PROJECT This contract will be started upon approval with a completion date within approximately 16 weeks. This Buy Board contract expires on September 30, 2025. FISCAL INFORMATION During FY23-24, City Council allocated funding for the amount of $280,000 to contribute towards the playground structure at Biddy Bye Park, previously known as “Parkside Property Playground”. These services will be funded from project account 400435403.1360.40100. Requisition #167179 has been entered into the Purchasing software system in the amount of $279,173.
