Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of second amendment to a Professional Services Agreement between the City of Denton and HDR Engineering, Inc., amending the contract approved by City Council on February 12, 2019, in the not-to-exceed amount of $3,342,509.00; amended by Amendment 1 approved by Purchasing; said
second amendment to provide for the additional design services of Hickory Creek Road Phase 3 realignment
street improvement project for the Capital Projects Department; providing for the expenditure of funds therefor; and providing an effective date (RFQ 6590-049 – providing for an additional second amendment expenditure amount not-to-exceed $154,772.00, with the total contract amount not-to-exceed $3,547,231.00).

INFORMATION/BACKGROUND
Hickory Creek Road is classified as a primary arterial on the City of Denton Mobility Plan. Phases 1 and 2 are complete, and Hickory Creek Road Phase 3 will extend the roadway approximately one (1) mile from Riverpass Drive west to FM-1830, creating a continuous four (4) lane divided east-west roadway (with the
option to be six (6) lanes) between FM 2499 and FM 1830. The project includes a new roadway with a 10-
foot trail on both sides of the road, street lighting, and a new bridge with five (5) foot sidewalks on the bridge structure. The new bridge will span Hickory Creek Road. Hickory Creek Road is identified on the City of Denton Mobility as a Primary Arterial, and upon construction, Hickory Creek Road Phase 3 will increase safety by removing a 90-degree curve from the current Hickory Creek alignment, add capacity,
and improve quality of life for both local and regional commuters.
Amendment No. 2 Costs: Multiple delays to the contractor resulted in changes in design, additional coordination with utility companies, and a new development. The consultant provided a highly detailed breakdown of the costs and
new rates to adjust from 2019 to 2025 fees. The City of Denton reviewed all costs, coordinated with the
consultant, and agreed to the final negotiated costs for Amendment No. 2 as detailed in the table below:

Project Timeline & Next Steps: The Updated Schedule includes approximately 18 months to complete the project from notice to proceed.
Estimated Completion is expected in Q4 2026. Request for Qualifications for professional engineering services was solicited using the City’s formal solicitation process. City Council approved a pre-qualified list of engineering firms on March 6, 2018, and June 5, 2018 (Ordinance 2018-331).
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On March 6, 2018, and June 5, 2018, City Council approved RFQ 6590 for a prequalified list of professional engineering firms (Ordinance 2018-331).
On February 12, 2019, City Council approved a contract with HDR Engineering, Inc., in the not-to-exceed amount of $3,342,509 (Ordinance 19-351). On October 4, 2021, Purchasing approved Amendment No. 1 with HDR Engineering, Inc., in the not-to-
exceed amount of $49,950, for a total not-to-exceed amount of $3,392,459. RECOMMENDATION Award Amendment No. 2 with HDR Engineering, Inc., to provide for the additional design services of
Hickory Creek Road Phase 3 realignment street improvement project for the Capital Projects Department, in a not-to-exceed amount of $154,772, for a total amended contract amount of $3,547,231. PRINCIPAL PLACE OF BUSINESS

The project is expected to be completed in Q4 2026, approximately 18 months from the proposed notice to proceed of Q2 2025. FISCAL INFORMATION
These services will be funded from Streets/Traffic account 250081402.1360.21100. Purchase Order #188961 will be revised to include the second amendment amount of $154,772. The total amended amount of this contract is $3,547,231.
