Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a second amendment to a Professional Services Agreement between the City of Denton and Kimley-Horn and Associates, Inc., amending the contract approved by the City Council on February 23, 2021, in the not-to-exceed amount of $461,100.00; amended by Amendment 1 approved by
City Council; said second amendment to acquire ultimate Right of Way for the Ryan Road Widening Project
for the Capital Projects Department; providing for the expenditure of funds therefor; and providing an effective date (RFQ 6590-097 – providing for an additional second amendment expenditure amount not-to-exceed $614,500.00, with the total contract amount not-to-exceed $2,313,865.15). The Public Utilities Board will consider this item on Monday, May 5, 2025.

INFORMATION/BACKGROUND
In February 2021, the City Council approved a contract with Kimely-Horn and Associates, Inc. for the 30% design of the Ryan Road Widening Project. The staff has evaluated the 30% project scope of Ryan Road Widening to progress the design from 30% to the final design of full-depth pavement reconstruction and
additional utility work. The addition of the utility work includes water and wastewater lines to current areas
that do not receive City utility services. In July 2024, the City Council approved the first amendment to provide funding to finish the project's design. In December 2024, the decision was made to acquire ultimate Right of Way for the Ryan Road widening
project in anticipation for future needs.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On February 23, 2021, City Council approved a contract with Kimley-Horn and Associates, Inc., in the not-
to-exceed amount of $461,100 (Ordinance 21-319).
On July 16, 2024, City Council approved Amendment No. 1 with Kimley-Horn and Associates, Inc. in the not-to-exceed amount of $1,238,265.15, for a total not-to-exceed amount of $1,699,365.15 (Ordinance 24-1342).
On May 5, 2025, this item will be presented to the Public Utilities Board (PUB) for consideration.
