Exhibit 1 - Agenda Information SheetCity of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement ACM: Christine Taylor DATE: May 20, 2025 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager to execute a Professional Services Agreement with Kimley-Horn and Associates, Inc., for engineering design services to eliminate the two at-grade crossings at Johnson Lane and Bonnie Brae Street and create a new at-grade crossing for the Brush Creek-Hickory Creek Phase 1 Project for the Traffic Department as set forth in the contract; providing for the expenditure of funds therefor; and providing an effective date (RFQ 7292-020 – Professional Services Agreement for engineering services awarded to Kimley-Horn and Associates, Inc., in the not-to-exceed amount of $225,000.00). STRATEGIC ALIGNMENT This action supports Key Focus Area: Enhance Infrastructure and Mobility. INFORMATION/BACKGROUND Currently, Brush Creek Road serves as an east-west corridor, extending from Country Club Road to the east and U.S. 377 (Fort Worth Drive) to the west. According to the Mobility Plan 2022, the future extension of Brush Creek Road will cross U.S. 377 and the Union Pacific Railroad (UPRR), ultimately connecting to Allred Road. This extension will enhance connectivity for existing residential communities on both sides of U.S. 377. Following UPRR regulations, establishing a new crossing requires the identification and closure of at least two existing crossings. This requirement is designed to maintain safety and operational efficiency while managing the overall number of crossings. To facilitate the new crossing, staff recommends the closure of two (2) existing crossings in proximity to the proposed location: Johnson Lane and U.S. 377 Crossing: Located 0.6 miles south of Brush Creek, this crossing experiences minimal traffic and commuting activity. Bonnie Brae Street and U.S. 377 Crossing: Situated 0.2 miles north of Brush Creek, this crossing has been identified as unsafe due to the existing angle at the intersection. City Hall 215 E. McKinney Street Denton, Texas www.cityofdenton.com Given the limited activity at the Johnson Lane crossing and the safety concerns associated with the Bonnie Brae crossing, the proposed closures are deemed feasible and necessary. Approval of this agreement will enable Kimley Horn and Associates to conduct the first phase, including the necessary studies and engineering design for the new crossing with UPRR. In total, this project will be completed in phases as shown below and, ultimately, will improve safety, new infrastructure, and regional connectivity. Project Description Estimated 3-Year Expenditure Phase 1 – Design (30 percent design) $225,000 Phase 2 – Design (100 percent design) 985,000 Phase 3 – Environmental Services 50,000 Total $1,260,000 Request for Qualifications for professional transportation engineering services was solicited using the City’s formal solicitation process. City Council approved a pre-qualified list of engineering firms on March 23, 2021 (Ordinance 21-554). PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On March 23, 2021, City Council approved RFQ 7292 for a prequalified list of professional transportation engineering firms (Ordinance 21-554). On February 19, 2025, City Council approved the agreement with Union Pacific Railroad (UPRR) for design review (Ordinance 25-234). RECOMMENDATION Award a contract with Kimely-Horn and Associates, Inc., for engineering design services to eliminate the two at-grade crossings at Johnson Lane and Bonnie Brae Street and create a new at-grade crossing for the Brush Creek-Hickory Creek Phase 1 Project for the Traffic Department, in a not-to-exceed amount of $225,000. Fort Worth, TX ESTIMATED SCHEDULE OF PROJECT The first phase project will start upon approval and be completed depending on the UPRR schedule. Staff will submit future phases for City Council consideration and tentatively expect all phases to be completed by August 30, 2027. FISCAL INFORMATION These services will be funded from Brush Creek Railroad Crossing account #360233469. Requisition #169917 has been entered into the Purchasing software system in the amount of $225,000. The budgeted amount for this item is $225,000.
