SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager to execute a contract with Brycer LLC, for the renewal of the inspection,
testing, and maintenance reporting system, the Compliance Engine, for the Fire Department, which is the
sole provider of this software, in accordance with Texas Local Government Code 252.022, which provides
that procurement of commodities and services that are available from one source are exempt from
competitive bidding, and if over $50,000, shall be awarded by the governing body; providing for the
expenditure of funds therefor; and providing an effective date (File 8867 – awarded to Brycer LLC, for
three (3) years, with the option for one (1) additional three (3) year extension, in the total six (6) year term).

INFORMATION/BACKGROUND
The Denton Fire Department (DFD) is responsible for tracking the inspection, testing, and maintenance of
fire protection systems within the City of Denton. Occupancies that have fire protection systems installed
are required by the DFD's adopted fire code to have the systems inspected and tested on a regular basis.
Without the use of The Compliance Engine, a web-based tool used to monitor the status of fire protection
systems, fire inspectors are required to witness the testing of all fire protection systems. Instead, the testing
contractor conducts the inspections and testing, as they already do, and then they submit their reports
directly to the DFD via Brycer’s web portal. This facilitates a more efficient review, tracking, and follow-
up process with occupants to correct deficiencies and maintain systems. The Compliance Engine provides
the DFD with a list of all fire protection systems in the City of Denton and their statuses. A DFD fire
inspection is not initiated unless there is a deficiency with a fire protection system. Instead of the business
owner paying the fee directly to the City, the testing contractor pays the fee of $35 per fire protection system
at the time the report is uploaded to The Compliance Engine. Then, The Compliance Engine pays the City,
after collecting a 6% fee.
This service has no cost to the City or the Denton Fire Department. The Compliance Engine has increased
the amount of revenue generated for the City. It has also allowed for a highly efficient use of Fire Prevention
resources.

services are exempt from competitive bidding, if over $50,000, shall be awarded by the governing body.
RECOMMENDATION
Award with a contract to Brycer, LLC, as a sole source supplier, for the inspection, testing, and maintenance
reporting system, The Compliance Engine, for the Fire Department, in a three (3) year, with the option for
one (1) additional three (3) year extension, in the total six (6) year term.

This is an initial three (3) year contract with options to extend the contract for one (1) additional three (3)
year period, with all terms and conditions remaining the same.
FISCAL INFORMATION
The service will be no cost to the City or Denton Fire Department. The Compliance Engine will increase
the amount of revenue generated. Revenue received will be deposited into the Fire Inspection account
1000.4412.
