SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a second amendment to a professional services agreement between the City of
Denton and Kimley-Horn and Associates, Inc., amending the contract approved by City Council on May
17, 2022, in the not-to-exceed amount of $751,100.00; amended by Amendment 1 approved by City
Council; said second amendment to extend the scope of work, including rerouting the sanitary sewer line,
add sewer lines/easements, and an additional full plan set and services for a new lift station for the Capital
Projects Department; providing for the expenditure of funds therefor; and providing an effective date (RFQ
7574-010 – providing for an additional second amendment expenditure amount not-to-exceed $160,000.00,
with the total contract amount not-to-exceed $1,135,400.00). The Public Utilities Board recommends
approval (6 - 0).

INFORMATION/BACKGROUND
The Texas Department of Transportation (TxDOT) is widening the Interstate 35 (I-35) corridor in numerous
areas throughout the City of Denton. The widening of I-35 presents conflicts with existing water and
wastewater infrastructures, requiring their relocation. Through a holistic approach, the Water Utilities
Division took the opportunity to evaluate the current and future demands in the region, as a direct impact
on the widening of I-35. Kimley-Horn and Associates was hired to assist with the design of the relocation
as well as to identify the future demands as a result of expected growth.
The original contract with Kimley-Horn was executed on May 17, 2022, to encompass all the I-35 projects
into one (1) contract. This proved to be an issue, and subsequently, the utility department decided to separate
the contract into project-specific contracts. However, when the contracts were divided, staff anticipated that
additional funds would be added to the Milam Creek Basin contract by amendment. In addition, during
design, it was found that added scope was required as well.
The First Amendment split the project into two (2) separate I-35 utility relocation projects that included
additional preliminary/final plan and profile drawings in preparation for the addition of approximately 500
linear feet of water main, 330 linear feet of 12-inch sanitary sewer force main, and 400 feet of 18-inch
through 33-inch gravity sanitary sewer line. The revised designs required additional easements, an
Environmentally Sensitive Area (ESA) study and mitigation plan, and a lift station.

This Second Amendment will cover the extended duration of construction due to the additional scope and
the substantial coordination with TxDOT for the agreements and reimbursements based off the additional
scope in Amendment No. 1. This amendment will reallocate money into other tasks that were realigned to
complete the design of the reroute of sanitary sewer line, added sewer lines/easements, and an additional
full plan set and services for a new lift station. To cover the cost of the added scope and funding reductions
in the contract, we are now recommending this Amendment.
Request for Qualifications for professional engineering services for Water and Wastewater was solicited
using the City’s formal solicitation process. City Council approved a pre-qualified list of engineering firms
on March 23, 2021 (Ordinance 21-546).
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On March 23, 2021, City Council approved RFQ 7574 for a prequalified list of professional engineering
firms for Water and Wastewater (Ordinance 21-546).
On May 17, 2022, City Council approved RFQ 7574-010 with Kimley-Horn and Associates, Inc., in the
not-to-exceed amount of $751,100 (Ordinance 22-898).
On September 19, 2023, City Council approved Amendment 1 with Kimley-Horn and Associates, Inc., in
the not-to-exceed amount of $975,400 (Ordinance 23-1660).
On August 11, 2025, the Public Utilities Board (PUB) recommended this item to the City Council for
consideration.
RECOMMENDATION
Award Amendment No. 2 with Kimley-Horn and Associates, Inc., to extend the scope of work including
rerouting the sanitary sewer line, add sewer lines/easements, and an additional full plan set and services for
a new lift station for the Capital Projects and Water Utilities Department, in a not-to-exceed amount of
$160,000.00, for a total amended contract amount of $1,135,400.

FISCAL INFORMATION
These services will be funded from Wastewater Utilities account 640468545.1365.21100. Purchase Order
#200157 will be revised to include the second amendment amount of $160,000. The total amended amount
of this contract is $1,135,400.
