1. SCOPE OF SERVICES AND REQUIREMENTS
The scope of work shall be finalized upon the selection of the Firm. The proposal submission shall
accurately describe your understanding of the objectives and scope of the requested services and
provide an outline of your process to implement the Scope of Services and Requirements. It is
anticipated that the scope proposal submission will include, at a minimum, the following:
1. Regulatory Responsibility
All work performed by the SERVICE PROVIDER will be in compliance with all
applicable Federal, State, County and City regulations.
2. Scrap Wire and Metals
This agreement refers to scrap and recyclables administered by the City of Denton,
collected at the Pole Yard, 1701 C Spencer Road, Denton, Texas; the Service Center, 901
B Texas Street, Denton, Texas; Solid Waste Landfill 1527 S Mayhill Rd. Denton Texas
76208 and other sites within the City of Denton, and facilities owned by the City of
Denton, Texas.

Recyclable material from the Solid Waste facilities:
The Solid Waste and Recycling Department in conjunction with its landfill and Public
Disposal Facility (PDF), collect white goods/appliances consisting of hot water heaters,
refrigerators, air conditioners, stoves, dishwashers, washers, dryers, microwaves etc.
The refrigerators, air conditioners (Freon containing appliance) are evacuated by certified
city staff and tagged or marked as evacuated.
The Solid Waste operations receives miscellaneous ferrous and non-ferrous items from
the public and are set aside for recycling. Some examples of items include: bicycles,
automotive parts, wheels, metal hand tools, metal building materials, tin, aluminum,
copper and other.
NOTE: Any material may be rejected if contaminated with excessive non-metallic’s, i.e.
mud, dirt, plastic, window glass, etc. However, the City of Denton does not guarantee or
imply that all items will be sorted by type or material.
3. Pick Up of Scrap Recyclables
Bins for collection of recyclables will be supplied by the SERVICE PROVIDER and
emptied as requested by the City of Denton from the Pole Yard, 1701 C Spencer Road,
Denton, Texas, 76201, the Service Center 901 B Texas St., Denton, Texas, 76209, the
Solid Waste Landfill 1527 S Mayhill Rd. Denton Texas 76208 or other sites designated
on an as needed basis by the City of Denton at no additional charge.
A. SERVICE PROVIDER will provide the necessary containers for which to place
scrap/recyclable materials. Currently, approximately 5-10 roll-off containers are in
use.
B. SERVICE PROVIDER will provide a pick-up service for containers. Pick up will
be made approximately within 24 hours of notification.
C. If SERVICE PROVIDER chooses to supply multiple labeled containers, the CITY
will make reasonable effort to sort materials but in no way guarantees proper sorting
by type or material.
4. Local Drop Off or Delivery Site (Required for Bid Consideration)
The same pricing terms and conditions shall apply as a minimum if the CITY opts to
deliver the scrap and recyclables to the SERVICE PROVIDER’S facility (please provide
addresses and hours of operations in submittal).
5. Revenues/Expenses
Revenues shall be paid to the CITY on a monthly basis. The following fees shall be in
effect:
A. Payment by SERVICE PROVIDER to CITY for herein referenced scrap/recyclables
shall be at the bid percentage of prevailing market prices as quoted in the “American
Metal Market”, Houston (if available), for non-ferrous scrap or iron and steel prices
on the day of pickup/delivery. A copy of that day’s prevailing rates shall be
attached to the weight receipts at time of payment and included in the invoicing.
B. All payments are to be made through the City of Denton Materials Management
Department, 901 B Texas Street, Denton, Texas 76209.
6. Marketing
The SERVICE PROVIDER accepts all responsibility for marketing of materials and
arranging for transportation of materials to market. The materials will be inspected at the
time of delivery to vendor to determine their acceptability, and to ensure that they contain
minimum quantities of non-recyclables upon acceptance. The SERVICE PROVIDER is
also responsible for disposal costs of non-recyclable materials except as otherwise agreed
to by the City of Denton.
7. Record Keeping
In accordance with State of Texas standards, vehicles will be weighted both prior to and
after collection of recyclable materials. Tare weights for vehicles can be used once
established. The CITY will be advised of what these tare weights are. The SERVICE
PROVIDER shall submit a monthly report providing a summary of the materials accepted
and tonnages. The reports should be delivered to the CITY no later than the 15th of each
month (following the end of the month) of pickup. Pickup sites must be identified.
8. Program Tracking
The CITY intends to periodically review this contract and determine if it is in the best
interests of the CITY to continue with the program. The CITY does not make any
guarantees as to the quantities or quality of materials recovered at the pickup centers or as
delivered to the SERVICE PROVIDER’S place of business.
9. Liability
The SERVICE PROVIDER shall assume all risks and responsibilities of loading, sorting,
and marketing recyclable materials listed herein and shall complete the work in and under
conditions that may be encountered or created without additional cost to the CITY.
10. Rights Reserved by The City/County
The CITY reserves the right to inspect the facilities and operations of the SERVICE
PROVIDER to assure the safety and authenticity of the SERVICE PROVIDER’S
operations. The CITY also reserves the right to review the SERVICE PROVIDER’S
records kept on commodities received from the CITY under the terms of this contract. The
CITY agrees to notify the SERVICE PROVIDER at least 24 hours prior to inspection.
11. Safety and Environmental Hazards
The City does not warrant or guarantee against the possibility that safety or environmental
hazards or potential hazards (including premises and special defects) may exist at the
City’s facilities. The Contractor shall be responsible for identifying any hazardous
conditions and notifying the City of these conditions in writing no later than 30 days after
contract award and prior to initiation of service delivery on the property. This will be
accomplished by the Contractor conducting an environmental assessment and an
occupational health, and safety inspection of the service bay or field service areas by
competent, qualified and appropriately licensed practitioners. The costs of these
inspections and any subsequent corrective action will be negotiated between the City and
the Contractor.
All contractors to the City of Denton are required to ensure absolute safety standards are
applied and enforced. The City of Denton will not be responsible for individual contractor
safety, and the awarded contractor shall not hold the City of Denton responsible. Known
hazards shall immediately be reported and all safety precautions shall be taken to prevent
potential safety issues from occurring.
The successful contractor, at their expense, shall comply with all applicable laws,
regulations, rules, and orders including, but not limited to, federal, state, and local;
regardless of when they become or became effective and furnish satisfactory evidence of
such compliance to City upon request.
Should any discharge, leakage, spillage, emission, or pollution of any type occur upon or
from the premises due to contractor’s use and occupancy thereof, the successful
contractor, at its expense, shall be obligated to clean all property affected thereby to the
satisfaction of the City (insofar as the property owned and controlled by City is concerned)
and any governmental body having jurisdiction thereover.
12. Contractor Standards of Performance
Monthly Time Standards - Contractors shall fully understand that the City relies on the
service of the RFP to provide vital municipal services, and the availability and reliability
of the service is of the essence. With this in mind, the Contractor shall meet the following
performance standards at all times. Labor disputes, strikes, and other events, except those
beyond the Contractor's control such as acts of God, shall not relieve the Contractor from
meeting these standards. For service category, the Contractor must ensure the given level
of service is achieved, within the designated number of working hours.
Contractor shall deliver services within specified delivery times for 95% of all orders.
13. ANTICIPATED PROBLEMS AND PROPOSED SOLUTIONS
Respondent shall offer written observations, based upon previous experiences in public
projects, addressing any anticipated problems and offer proposed solutions to those
problems.
