Scope of Work
IFB #8115 Spoil Beneficial Reuse
1.0 SCOPE AND CLASSIFICATION
1.1 SCOPE - This specification establishes minimum requirements for beneficial reuse
of spoils generated by the City of Denton. Sections include Scope and
Classification, General Requirements, Basis for Award, and Invoice / Billing
Requirements.
1.2 CLASSIFICATION – The service will be used by the City of Denton to provide spoils
materials for beneficial reuse.
This specification, until revised or rescinded, shall apply to each future purchase and
contract for the commodity described herein. Retain for future reference.
2.0 GENERAL REQUIREMENTS
2.1 Spoils Materials: The Contractor shall accept spoils materials such as
flexible base, hot mix asphaltic concrete, concrete, asphalt millings, soil,
vegetation, wet soil from hydro-excavation, rock, and other debris generated
from all types of City of Denton related maintenance activities.
2.2 Spoils Beneficial Reuse Site: The Contractor shall provide a spoils beneficial
reuse site that is located within Denton County preferred within 10 miles of
the city limits of the City of Denton. The Contractor shall furnish all labor,
tools, and equipment necessary to operate a spoils beneficial reuse site. Only
City of Denton trucks and non-city trucks (City hired trucking services) will be
invoiced on a per load basis. The City will notify Contractor of any non-city
trucks that will be operating along with City vehicles.
Seven (7) day a week, 24-hour operation-The site shall be open for spoils
acceptance 24 hours a day, weather permitting. The site does not have to be staffed
and access to designated after hours spoil beneficial reuse area can be designated.
2.3 Permits: The Contractor shall have all the applicable permit or
registration required for the spoils beneficial reuse site, Denton
County/State of Texas. The Contractor shall provide a copy of
registration(s)/permit(s) with bid. During the life of the contract,
contractor shall notify the City of Denton if such registration/permit is
amended, renewed, or replaced.

2.4 Ownership of Spoils: The Contractor shall assume all responsibility of spoils
material when deposited at the Contractors spoils beneficial reuse site. All
material will be accepted “AS IS, WHERE IS” and “WITH ALL FAULTS”. The
City makes no warranties or representations as to the content of the
materials. Any description of the material listed is for identification purposes
and does not constitute any warranty or representation that the material
conforms to such description.
2.5 Safety: The contractor shall be responsible for job safety at the spoils
beneficial reuse site. During performance of work, Contractor shall provide
and maintain all passageways, guard fences, lights, and other protective
measures required by applicable laws, rules, regulations, ordinances, and
local conditions. Contractor is responsible for the continuous monitoring of
safety conditions at the spoils beneficial reuse site to determine if it is safe
and suitable for spoils handling. If an unsafe condition arises at the spoils
beneficial reuse site, contractor shall take corrective action (within 24 hours)
prior to accepting future loads of spoils.
2.6 Measurement and Payment: The services provided will be paid for at the
unit bid price per load of spoils material basis. A Load shall be defined as any
amount of spoils materials up to *12 cubic yards loaded on a tandem axle
dump truck. The trucks will be identified with the City or Denton logo on
the doors of the vehicle. City contracted haulers will be identified by the City
of Denton and the City of Denton will notify site operator of this contracted
service. Contractor shall provide a receipt to the driver for each truckload of
spoils material hauled.

3.0 BASIS FOR AWARD
Basis for award will be as described below. Bidders shall provide their best pricing
for the service they can provide on exhibit 1 – Pricing Sheet.
Basis for award will be to the lowest responsive bidder of item offering seven (7) days a
week, 24-hour operation on the pricing sheet; bidders must meet all requirements of the
bid in order to be considered responsive. If there are no responsive bidders for the item
then award will be to the lowest responsive bidder that meets as close as possible to
the requirements.
