SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a first amendment to a contract between the City of Denton and DiVal Safety
Equipment, Inc., amending the contract approved by City Council on March 5, 2024, in the not-to-exceed
amount of $600,000.00; said first amendment to continue to purchase self-contained breathing apparatus
(SCBA) for the Fire Department; providing for the expenditure of funds therefor; and providing an effective
date (RFP 8432 – providing for an additional first amendment expenditure amount not-to-exceed
$150,000.00, with the total contract amount not-to-exceed $750,000.00).

INFORMATION/BACKGROUND
A self-contained breathing apparatus (SCBA) is a respiratory protective device worn by firefighters to
provide breathable air in toxic and hazardous environments. The Fire Department began using SCBAs
manufactured by Scott Safety Corporation in the year 2000. Since then, the manufacturer has issued many
updates to accommodate safety requirements that have been instituted by the National Fire Protection
Association. Fire department ambulances, engines, and trucks are all equipped with SCBAs. When new
apparatuses are purchased, new SCBAs are purchased as well.
The Fire Department performs approximately 100 percent of the SCBAs flow tests in-house. These tests
are required annually by the Texas Commission on Fire Protection (TCFP) and the National Fire Protection
Association (NFPA). When the test reveals a need, or anytime damage or repair is needed, the department
utilizes DiVal Breathing Air Products as a resource for warranty repairs and replacement parts. This allows
the City of Denton Fire Department to maintain the use of current safety-appropriate respiratory protection
during firefighting and rescue responses.
The City’s current contract with DiVal Safety Equipment, Inc. is effective through March 4, 2029; however,
a formal solicitation for these services is planned for release in Spring 2026. Due to recent apparatus
acquisitions in prior years, the existing not-to-exceed (NTE) amount under the current agreement is
projected to be fully expended by February 2026. This amendment seeks additional funding to ensure
continuity of essential purchases through the remainder of FY 2025–26. Without this adjustment, the City
would be unable to procure necessary equipment and supplies to support ongoing operations until the new
solicitation process is completed.

On March 5, 2024, City Council approved a contract with DiVal Safety Equipment, Inc., in the not-to-
exceed amount of $600,000 (Ordinance 24-407).
RECOMMENDATION
Award Amendment No. 1 with DiVal Safety Equipment, Inc., to continue to purchase self-contained
breathing apparatus (SCBA) for the Fire Department, in a not-to-exceed amount of $150,000, for a total
amended contract amount of $750,000.

FISCAL INFORMATION
These services will be funded from Fire Operating account 320100.6393. Requisitions will be entered on
an as-needed basis. The total amended amount for this contract is $750,000.
