SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager to execute a contract extension between the City of Denton and FX5 Utility
Construction LLC through November 18, 2027, for Underground Electric Installation for Denton
Municipal Electric; and declaring an effective date (RFP 7633 – extending a contract with FX5 Utility
Construction LLC, to November 18, 2027). The Public Utilities Board recommends approval (5 - 0).

INFORMATION/BACKGROUND
This contract encompasses all labor, equipment, tools, supervision, and associated administrative and
insurance costs required by the contractor to complete the installation of electric service facilities under the
direction of Denton Municipal Electric (DME) staff. DME supplies all permanent electric materials to be
installed by the contractor. Work performed under this agreement includes underground construction in
residential subdivisions, commercial and industrial developments, exit feeders for new substations, and
overhead-to-underground conversion projects. This agreement does not guarantee any minimum amount of
construction and will be used on an as-needed basis at DME’s discretion.
The proposed contract extension would allow DME to continue utilizing FX5 Utility Construction LLC to
complete several underground projects—such as Hunter Ranch/Landmark, the I-35W conversions, and the
four UNT Express Feeder projects—before issuing a new solicitation. Due to economic impacts during
COVID-19 and the delay of several major projects, more than $5,000,000 remains available on this contract.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On May 18, 2021, City Council approved a contract with FX5 Utility Construction LLC, in the not-to-
exceed amount of $15,000,000 (Ordinance 21-889).
On January 28, 2025, Purchasing approved a six (6) month contract extension with FX5 Utility Construction
LLC, extending the contract to November 16, 2026.
On June 8, 2026, the Public Utilities Board (PUB) recommended this item to the City Council for
consideration.

FISCAL INFORMATION
These services will be funded from the numerous Electric Capital Project Funds and requisitions will be
entered on an as-needed basis. The City will only pay for services rendered and is not obligated to pay the
full contract amount unless needed.
