SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a second amendment to a Professional Services Agreement between the City of
Denton and Kimley-Horn and Associates, Inc., amending the contract approved by the City Council on May
3, 2022, in the not-to-exceed amount of $312,000.00; amended by Amendment 1 approved by Purchasing;
said second amendment to provide grant submission support for construction funding through the Federal
Railroad Administration Consolidated Rail Infrastructure and Safety Improvements Program of the Grade
Crossing Improvements of the Downtown UPRR Quiet Zone Project for Capital Projects; providing for the
expenditure of funds therefor; and providing an effective date (RFQ 7292-006 – providing for an additional
second amendment expenditure amount not-to-exceed $65,000.00, with the total contract amount not-to-
exceed $425,500.00).

INFORMATION/BACKGROUND
Implementation of a Quiet Zone (QZ) along the Union Pacific Railroad (UPRR) in downtown Denton at
the Prairie, Sycamore, Hickory, and McKinney Streets grade crossings was approved as part of the City’s
2014 Bond Program.
On September 20, 2020, the City entered into a Public Highway At-Grade Crossing Agreement with
UPRR (Ordinance Number 20-1699), establishing the framework for improvements required to support the
future Quiet Zone.
In late 2021, staff determined that pedestrian connectivity improvements should be constructed
simultaneously with the Quiet Zone project to provide continuous sidewalks through the railroad crossings,
including any UPRR-required pedestrian safety enhancements. Due to these additional needs and other
Federal Railroad Administration (FRA) & UPRR requirements, Engineering staff elected to have the project
designed by a consultant. On May 3, 2022, the City Council approved a Professional Services Agreement
with Kimley-Horn and Associates for the Downtown UPRR Quiet Zone Engineering Services, using the
pre-qualified list from RFQ 7292 for professional transportation engineering services.

On February 1, 2024, Amendment No. 1 in the amount of $48,500.00 was authorized by Purchasing to
provide full-depth repair engineering services for Sycamore Street between Bell Avenue and the UPRR
right-of-way.
On April 20, 2026, the Federal Railroad Administration (FRA) released new grant funding opportunities
for projects ready for construction. Following coordination with FRA staff, it was determined that the City’s
Downtown UPRR Quiet Zone Project meets eligibility criteria for both the Consolidated Rail Infrastructure
and Safety Improvements (CRISI) Program and the Railroad Crossing Elimination (RCE), now known as
the Crossing Safety Program.
Amendment No. 2 provides the additional engineering and support services necessary to complete grant
applications for both the CRISI and RCE programs.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On March 23, 2021, Council approved RFQ 7292 for a prequalified list of professional transportation
engineering firms (Ordinance 21-554).
On May 3, 2022, Council approved a contract with Kimley-Horn and Associates, Inc., in the not-to-exceed
amount of $312,000 (Ordinance 22-916).
RECOMMENDATION
Award Amendment No. 1 with Kimley-Horn and Associates, Inc., for grant submission support for
construction funding through the Federal Railroad Administration Consolidated Rail Infrastructure and
Safety Improvements Program of the Grade Crossing Improvements of the Downtown UPRR Quiet Zone
Project for Capital Projects, in a not-to-exceed amount of $65,000, for a total amended contract amount of
$425,500.

Applications will be submitted to FRA in accordance with the grant submittal requirements.
FISCAL INFORMATION
These services will be funded from project account 310001449.1360.21100. Purchase Order #200043 will
be revised to include the second amendment amount of $65,000. The total amended amount of this contract
is $425,500.
