HomeMy WebLinkAboutExhibit 1 - Agenda Information Sheet Amendment 2City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement ACM: Christine Taylor DATE: August 4, 2026 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a second amendment to a contract between the City of Denton and Mustang Apparel, Inc. dba Incentive Brands, amending the contract approved by City Council on July 28, 2020, in the not-to-exceed amount of $1,450,000.00; said second amendment to continue to provide additional spending authority for workwear for the Procurement Department; amended by Amendment 1 approved by City Council; providing for the expenditure of funds therefor; and providing an effective date (RFP 7315 – providing for an additional second amendment expenditure amount not-to-exceed $362,500.00, with the total contract amount not-to-exceed $1,812,500.00). INFORMATION/BACKGROUND This amendment will allow departments to continue using this contract while the Procurement Department completes a new solicitation. The contract covers workwear used by various City departments on an as- needed basis, including shirts, pants, hats, high-visibility gear, and more. It is a citywide contract utilized by nearly every department. The original not-to-exceed was calculated using historical usage data. The estimated annual need was $290,000 for a five (5) year not-to-exceed (NTE) amount of $1,450,000. On December 16, 2025, City Council rejected the award of workwear for various City of Denton departments to Mustang Apparel, Inc. dba Incentive Brands, and approved rejecting all proposals on RFP 8926 workwear instead. On February 3, 2026, City Council approved Amendment No. 1 to extend this contract to January 28, 2026 and allow City staff to continue purchasing workwear items while we prepare to resolicit and evaluate. The new solicitation was advertised to prospective vendors on Friday, July 31, 2026. Adding the additional $362,500 to the current NTE will allow departments to continue using this contract until a new one is in place. PRIOR ACTION/REVIEW (Council, Boards, Commissions) On July 28, 2020, City Council approved a contract with Mustang Apparel, Inc. dba Incentive Brands, in the not-to-exceed amount of $1,450,000 (Ordinance 20-1306). RECOMMENDATION Award Amendment No. 2 with Mustang Apparel, Inc. dba Incentive Brands, to continue to provide workwear for various city departments for the Procurement Department, in a not-to-exceed amount of $362,500, for a total amended contract amount of $1,812,500. PRINCIPAL PLACE OF BUSINESS Mustang Apparel, Inc. dba Incentive Brands Plano, TX ESTIMATED SCHEDULE OF PROJECT This contract expires on January 28, 2027. FISCAL INFORMATION These products and services will be funded through the department’s budget on an as-needed basis. The City will only pay for services rendered and is not obligated to pay the full contract amount unless needed.
