SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a third amendment to the “Memorandum of Understanding – the Environment”
between the City of Denton and the University of North Texas, amending the Memorandum of
Understanding approved by City Council on May 13, 2003, in the not-to-exceed amount of $30,000.00 per
project; said third amendment to the “Memorandum of Understanding – the Environment” will extend the
effective date, which provides for extension of the terms of said agreement, until September 30, 2031;
providing for the expenditure of funds therefor; and providing an effective date.

INFORMATION/BACKGROUND
The City of Denton established a Memorandum of Understanding (MOU) with the University of North
Texas (“UNT”) in May 2003 to streamline the process of performing collaborative environmental projects.
Prior projects have involved projects such as mosquito assessment/surveillance and tree planting survival.
Said MOU has been amended twice before and extended several times. The current MOU expires on
September 30, 2026, unless renewed.
Both the City of Denton and UNT see value in continuing the MOU. Individual projects under this MOU
may not exceed $30,000 per project, and the total amount of research dollars may not exceed $100,000 per
contract year. Each project under the MOU will have a Scope of Services agreed upon by both parties before
commencement.
Amendment No. 3 to the MOU will extend the MOU through September 30, 2031, and increase the project
amount from $25,000 to 30,000 to maintain the level of service with rising costs. This MOU itself does not
authorize the expenditure of any funds, and any funds expended under the conditions of the MOU are
required to go through standard approval processes of the City of Denton.
OPTIONS
1. Approve Amendment No. 3 further extending the Memorandum of Understanding.
2. Direct staff to draft changes to Amendment No. 3 to the Memorandum of Understanding. Any
changes will need to be negotiated with UNT staff.

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On May 13, 2003, City Council approved a Memorandum of Understanding – the Environment with the
University of North Texas, in the not-to-exceed amount of $30,000.00 per project (Ordinance 2003-19).
On May 2, 2006, City Council approved Amendment No. 1 with the University of North Texas, extending
the term (Ordinance 2006-111).
On April 16, 2013, City Council approved an extension with the University of North Texas (Ordinance
2013-105).
On April 26, 2016, City Council approved an extension with the University of North Texas (Ordinance
2016-128).
On January 11 2022, City Council approved Amendment No. 2 with the University of North Texas,
extending the term (Ordinance 22-001).
RECOMMENDATION
Award Amendment No. 3 with the University of North Texas, extending the agreement until September 30,
2031.

FISCAL INFORMATION
Funds are budgeted by Environmental Services and Sustainability, Watershed Protection Division, from the
operating budget for mosquito monitoring in accordance with the West Nile Virus Mosquito Surveillance
and Response Plan. Other projects will be funded by the requesting department.
