AGENDA INFORMATION SHEET
DEPARTMENT: Procurement
ACM: Christine Taylor
DATE: September 22, 2026
SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a first amendment to a Professional Services Agreement between the City of
Denton and Kimley-Horn and Associates, Inc., amending the contract approved by City Council on October
14, 2025, in the not-to-exceed amount of $1,189,900.00; said first amendment to continue to provide
additional design services relating to the NCTCOG Transportation Alternatives (TA) Grant as set forth in
the contract; providing for the expenditure of funds therefor; and providing an effective date (RFQ 8377-
010 – providing for an additional first amendment expenditure amount not-to-exceed $196,200.00, with the
total contract amount not-to-exceed $1,386,100.00).
STRATEGIC ALIGNMENT
This action supports Key Focus Area: Enhance Infrastructure and Mobility.
INFORMATION/BACKGROUND
In November 2024, the City of Denton submitted and was awarded construction funding (in May of 2025)
for two (2) projects with the NCTCOG TA set-aside call for projects. The two (2) projects are Sycamore
Trail and Newton Rayzor Elementary School, for which the program pays 80% of the construction costs
for the projects. The City will pay for design costs and 20% of the required matching construction costs,
plus any overall cost overage, if any. These proposed improvements are new sidewalks, signal
improvements, separated bike lanes, and other safe pedestrian facilities around the school and other
identified trail areas.
Based on recent district rezoning, additional sidewalk gaps were identified around Newton Rayzor
Elementary. To address this issue, the first amendment updates the contract to include additional field
survey work to support further design along Broadway Street, Panhandle Street, Linden Drive, Ponder
Street, Parkside Drive, Crescent Street, Bryan Street, and Fulton Street.
On October 14, 2025, the Professional Services Agreement between the City of Denton and Kimley-Horn
and Associates, Inc. was executed for the not-to-exceed amount of $1,189,900.00. However, Ordinance 25-
1821 was written for $1,189,000. Purchasing approved the additional $900 to the not-to-exceed amount.
