ACM: Christine Taylor
DATE: September 22, 2026
SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager to execute Change Order No. 1 to the contract between the City of Denton
and Northstar Construction, LLC, for additional quantities and services at Bowling Green Park for the Parks
and Recreation Department; providing for the expenditure of funds therefor; and providing an effective date
(CSP 8635 – Change Order No. 1 in the not-to-exceed amount of $268,253.60, for a total contract award
aggregated to $2,116,237.85).
STRATEGIC ALIGNMENT
This action supports Key Focus Area: Strengthen Community and Quality of Life.
INFORMATION/BACKGROUND
The City of Denton Parks and Recreation Department owns an 18-acre site, “Bowling Green Park,” located
at 2200 Bowling Green Street, Denton, TX 76207, that extends to Windsor Drive. In December of 2020,
Council approved a contract with Pacheco Koch Consulting Engineers for the design and development of
construction documents for Bowling Green Park Improvements to include a loop trail, raised garden beds,
Americans with Disabilities Act (ADA) improvements, landscaping, and typical park amenities.
A civil engineering plan set from Rocky Summit Engineering Consulting, LLC was completed in October
2016 for a south sidewalk along Windsor Drive that would connect the approved Fireside community to
Northlakes Recreation Center. These civil engineering plans included a new ten-foot linear trail with ADA
access ramps at the intersecting roadways along this section.
In 2025, Westwood (formerly Pacheco Koch Consulting Engineers) was asked to combine the design of
Bowling Green Park and the 2016 civil plans for the connection piece along Windsor into a single plan set
to go to bid for construction. Westwood’s final stamped plan set that went through the Development
Assistance Team (DAT) review went out to bid in the winter of 2025.
A construction contract was executed with Northstar Construction LLC on February 17, 2026. In July 2026,
the contractor alerted staff to a possible issue regarding contracted quantities from the Unit Price Proposal
form. Staff met with the contractor to evaluate the correct quantities needed to complete the project in
comparison to the Bid Unit. During the meeting, it was determined that there is a shortfall in concrete, sod,
temporary irrigation, and subgrade prep. Additionally, during construction, staff met with the contractor
regarding possible impacts to portions of the site that would need additional grading. Lastly, staff and the

contractor have worked with Denton’s Interim City Engineer to evaluate the original plans and adjust needs
for the drainage areas.
The proposed change order also addresses project savings from the executed contract, including tree
removal credit and items for drainage that will be substituted out in lieu of the newly approved drainage
plan.
