AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL
CORPORATION, AUTHORIZING THE APPROVAL OF CHANGE ORDER NO. 6 TO THE
CONTRACT BETWEEN THE CITY OF DENTON AND ZACHRY CONSTRUCTION, INC.,
FOR THE MAYHILL ROADWAY IMPROVEMENTS PROJECT; PROVIDING FOR THE
EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN EFFECTIVE DATE (IFB 6389
CHANGE ORDER NO. 6 IN THE NOT-TO-EXCEED AMOUNT OF $137,836.23, FOR A
TOTAL CONTRACT AWARD AGGREGATED TO $35,490,677.81).
WHEREAS, on June 27, 2017, by Ordinance No. 2017-189, the Council awarded a contract
to Zachry Construction, Inc., in the amount of $35,877,414.52 for the Mayhill Road Widening and
Improvements Project; and
WHEREAS, the Staff having recommended, and the City Manager having recommended to
the Council that a change order be authorized to amend such contract agreement with respect to the
scope of work, and a decrease in the payment amount; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1, Change Order No. 6, increasing the amount of the contract between the City
and Zachry Construction, Inc,, which is on file in the office ofthe Purchasing Agent, in the amount
of One Hundred Thirty-Seven Thousand Eight Hundred Thirty Six and 23/100 ($137,836.23) dollars
is hereby approved, and the expenditure of funds therefore is hereby authorized in accordance with
said change order. The total purchase order amount increases to $35,490,677.81.
SECTION 2. This ordinance shall become effective immediately upon its passage and
approval.
