AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL
CORPORATION, AUTHORIZING THE APPROVAL OF THE FIRST AMENDMENT TO A
PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF DENTON AND BATES
AND MARTIN ARCHITECTS, LLC, AMENDING THE CONTRACT APPROVED BY
PURCHASING STAFF ON OCTOBER 22, 2018, 1N THE NOT-TO-EXCEED AMOUNT OF
34,300, SAID FIRST AMENDMENT TO PROVIDE ARCHITECTURAL SERVICES AND
LIGHTING FOR 12 TENNIS COURTS FOR THE PARKS AND RECREATION DEPARTMENT;
PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN
EFFECTIVE DATE (FILE 6915 - PROVIDING FOR AN ADDITIONAL EXPENDITURE
AMOUNT NOT-TO-EXCEED $121,368, FOR A TOTAL CONTRACT AMOUNT NOT-TO-
EXCEED $155,668).
WHEREAS, on October 22, 2018, the Purchasing Staff awarded a Professional Services
Agreement to Bates and Martin Architects, LLC, in the amount of $34,300 for Architectural and
Engineering Design Services for North Lakes Tennis Center for the City of Denton; and
WHEREAS, the Staff having recommended, and the City Manager having recommended to
the Council that an amendment be authorized to amend such contract agreement with respect to the
term of the agreement and an increase in the payment amount; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The First Amendment, increasing the amount of the contract between the City
and Bates and Martin Architects, LLC, which is on file in the office of the Purchasing Agent, in the
amount of One Hundred Twenty One Thousand Three Hundred Sixty Eight and 0/100 ($121,368)
Dollars, is hereby approved and the expenditure of funds therefor is hereby authorized in accordance
with said amendment. The total contract amount increases to $155,668.
SECTION 2. This ordinance shall become effective immediately upon its passage and

WHEREAS, theCity deemsitnecessarytofurtherexpandthegoods/services
providedbyConsultanttotheCity;
NOWTHEREFORE, theCityandConsultant (hereafter collectivelyreferredtoasthe
goodandvaluableconsiderations, doherebyAGREEtothefollowingFirstAmendment,
whichamendsthefollowingtermsandconditionsofthesaidAgreement, towit:

reimbursementfornon-laborexpensesanamountnottoexceed $121,368.
2. ThisAmendmentmodifiestheAgreementamounttoprovideanadditional
121,368fortheadditionalserviceswitharevisedaggregatenot-to-exceedtotalof
155,668.
ThePartiesheretoagree, thatexceptasspecificallyprovidedforbythisAmendment, that
alloftheterms, covenants, conditions, agreements, rights, responsibilities, andobligations
oftheParties, setforthintheAgreementremaininfullforceandeffect.
