AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL
CORPORATION, AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT
EXTENSION BETWEEN THE CITY OF DENTON AND JAGOE-PUBLIC COMPANY,
THROUGH NOVEMBER 7, 2019, TO PROVIDE THE CONSTRUCTION OF ASPHALT AND
CONCRETE STREET SECTIONS AND REPAIRS; AND DECLARING AN EFFECTIVE DATE.
FILE 6730 — EXTENDING A CONTRACT WITH JAGOE-PUBLIC COMPANY, TO
NOVEMBER 7, 2019)
WHEREAS, Ordinance 18-583 authorized a contract to Jagoe-Public Company, for one (1)
year for the construction of asphalt and concrete street sections and repairs for the City of Denton,
which is on file in the office of the Purchasing Agent; and
WHEREAS, the staff having recommended, and the City Manager having recommended to
the City Council that an extension to the existing purchasing authority approved by Ordinance 18-
583 be authorized between the City and Jagoe-Public Company for six months; and
WHEREAS, the City Council finds that the action taken herein is in the public interest;
NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference.
SECTION 2. The authority to receive construction of asphalt and concrete street sections and
repair services from Jagoe-Public Company, authorized by Ordinance 18-583, is hereby extended
under this ordinance for six (6) months.
SECTION 3. The City Council delegates the authority to the City Manager to take any
actions that may be required or permitted to be performed by the City of Denton under this ordinance
to the City Manager of the City of Denton, Texas, or his designee.
SECTION 4: This ordinance shall become effective immediately upon its passage and
approval.

Agreement, andtheCitydeemsitnecessarytofurtherexpandtheservicesprovidedby
Contractor totheCity, andtoprovideanadditionalsixmonth term withthisFirst
Amendment.
WHEREAS, theCity deemsitnecessarytofurtherexpandthegoods/services
providedbyContractortotheCity; and
NOWTHEREFORE, theCityandContractor (hereaftercollectivelyreferredtoasthe
nsiderationoftheirmutualpromisesandcovenants, aswellasforother
goodandvaluableconsiderations, doherebyAGREEtothefollowingFirstAmendment,
whichamendsthefollowingtermsandconditionsofthesaidAgreement, towit:
1. ThisAmendmentmodifiestheAgreementamounttoprovideanadditionalsix (6)
monthtermforadditionalservicesandmaterialstobeprovidedinaccordancewith
thetermsoftheAgreement. ThetermoftheAgreementisextendeduntil
November7th, 2019.
ThePartiesheretoagree, thatexceptasspecificallyprovidedforbythisAmendment, that
alloftheterms, covenants, conditions, agreements, rights, responsibilities, andobligations
oftheParties, setforthintheAgreementremaininfullforceandeffect.
