Ref: RFP 5062 — Supply of Underground Distribution and Substation Control Cables
Mr. McCathren:
The City of Denton (.COD) has reviewed and accepts the temporary amendment to contract line mein seven
for the supply of #2 AL EPR, triplexed cable (COD # 28080040.). The following terms shall apply:
I Irby agrees to allocate to DME cover credits for Okonite orders made by the City between December 1,
2013 and May 31, 2014 and received by the City before October 30, 2014.
Z. Irby agrees to compensate DME for a cover payment in the forn-i of an Irby sales credit, applied to a
pre-existing Irby invoice to DME, billed in the same month as the Okonite shipment occurs. In the
event no invoices are due to Irby,, then Irby will issue a check within 120 days of receipt of
documentation.
3. Cover credits are calculated on individual DME purchases of the subject conductor design of Okonite
brand cable only.
4. Cover credits equal Okonite sell price (as shown on Okonite invoice to DME) minus Irby contract price
multiplied by shipped cable length.
5. Covered credits will apply to Okonite shipments totaling 10,200 feet or less during the period listed
above.
6. Subject contract remains otherwise unaltered through (4) renewal options., ending in May 2017.
7. Irby will no longer be penalized on the "indicators of probable performance" evaluation criteria for
future RFP initiatives.
