SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
rejecting any and all competitive proposals under RFP 6890 for the supply of a utility-scale for solar energy
for the City of Denton; and providing an effective date (RFP 6890). The Public Utilities Board recommends
approval (4 - 0).
RFP INFORMATION/BACKGROUND
The City of Denton issued a request for proposals for the supply of a utility-scale for solar energy on
October 30, 2018. All proposals received were subject to a twenty-year minimum delivery period. Given
recent changes in the electric power markets, such a lengthy delivery period may not be as advantageous as
it once appeared. Although staff has not ruled out consideration of a twenty-year period, it believes that
examination of offers with more time flexibility could yield a better result for the City.
Requests for Proposals were sent to 224 prospective suppliers of this item. In addition, specifications were
placed on the Materials Management website for prospective suppliers to download and advertised in the
local newspaper. Eighteen (18) proposals were received and evaluated based upon published criteria
including location of the project, corporate and professional experience of this magnitude and complexity,
production profile, purchased power agreement value and operational viability. Staff has decided to reject
all proposals generated from RFP 6890 and re-solicit this procurement with appropriate changes to the
requested timeframe.
In accordance with the Local Government Code 252.043, the City Council may reject any and all bids.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On February 10, 2020, the Public Utilities Board (PUB) recommended this item to the City Council for
consideration.
RECOMMENDATION
Staff recommends rejection of all proposals for the supply of a utility-scale for solar renewable energy.
