Lewisville, City of-5104-Award/Ordinance/Pricing • ORDINANCE NO. 0,9 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE CITY OF LEWISVILLE RELATING TO PARTICIPATION IN VARIOUS CITY OF DENTON CONTRACTS WHICH PROVIDE FOR THE PURCHASE OF VARIOUS GOODS AND SERVICES; AND DECLARING AN EFFECTIVE DATE: THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I That the City Manager is hereby authorized to execute an Interlocal Agreement with the City of Lewisville relating to participation in various City of Denton contracts which provide for the purchase of various goods and services, a copy of such agreement is attached hereto and incorporated by reference. PROUTY, CITY ATTORNEY BY: IINITERLOCAL.OTHER 1 • THE STATE OF TEXAS COUNTY OF DENTON INTERLOCAL AGREEMENT COOPERATIVE PURCHASING AGREEMENT This agreement is made on the 14th day of April, 1997, between the City of Lewisville, State of Texas and the City of Denton, Texas. In consideration of the mutual covenants contained herein and pursuant to the authority permitted under Chapter 791 of the Texas Government Code, the Interlocal Cooperation Act, City of Lewisville and City of Denton agree as follows: 1. Purpose The City of Lewisville wishes to enter into this Interlocal Agreement to authorize participation in various City of Denton contracts for the purchase of various goods and services. The participation in this cooperative program will be highly beneficial to the taxpayers through the anticipated savings to be realized. II. Duration of Agreement • This agreement, which tenninates as of its effective date, all prior agreements, written or oral, between the parties concerning the same services/materials, shall become effective on April 14, 1997, and shall continue in full force and effective thereafter until terminated by either party on thirty (30) days written notice to the other. III. Relationship of Parties The parties intend that the entity, in receiving products and/or services specified in this agreement, shall act as an independent purchaser and shall have control of its needs and the mauler in which they are acquired. Neither the City of Lewisville, its agents, employees, volunteer help nor any other person operating under this contract shall be considered an agent or employee of the City of Denton and shall not be entitled to participate in any pension plans or other benefits that the City of Denton provides its employees. CITY OF DENTON CITY OF LEWISVILLE BY: BY.- Date ~(Q Date 6 • RESOLUTION NO. 2206-4-97 (R) A RESOLUTION APPROVING AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF LEWISVILLE, TEXAS AND CITY OF DENTON, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of Lewisville, Texas, pursuant to the authority granted by Chapter 791 of the Texas Government Code, the interlocal Cooperation Act, as amended, desires to participate in an interlocal purchasing program of City of Denton; and, WHEREAS, the City Council is in the opinion that participation in these programs will be highly beneficial to the taxpayers of this City, Through the anticipated savings to be realized; NOW, THEREFORE, BE IT RESOLVED that the City Council of Lewisville, Texas shall enter into an Interlocal Agreement with City of Denton to participate in various contracts which provide for the purchase of various goods and services; whereby the City Manager or his designee is authorized and directed to sign and deliver all necessary requests and other documents in connection therewith for and on behalf of the City of Lewisville, Texas, and the effective date shall become April 14, 1997, and shall continue in fiill force and effect thereafter until tenninated by either party on thirty (30) days written notice to the other. • DULY PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF LEWISVILLE, TEXAS, ON THIS THE 14TH DAY OF APRIL, 1997.
