AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXTEND AN INTERLOCAL
AGREEMENT WITH NORTH TEXAS REGIONAL LIBRARY SYSTEM (NTRLS) TO
AUTHORIZE PARTICIPATION IN THE PURCHASE OF LIBRARY BOOKS AND RELATED
VARIOUS GOODS AND SERVICES; AUTHORIZING THE EXPENDITURE OF FUNDS; AND
DECLARING AN EFFECTIVE DATE:
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION T. That the City Manager is hereby authorized to execute the attached agreement,
a copy of which is attached hereto and incorporated by reference herein.
SEC-110N Ii_- That the City Manager is authorized to expend funds pursuant to the
agreement for the purchase of Library Books and Services.
SECTION III. That this ordinance shall become effective immediately upon its passage and
approval.

COOPERATIVE PURCHASING AGREEMENT
This agreement is made on the A 3d day of 1997, between The City
of Denton, State of Texas, and the North Texas Regional Library System (NTRLS).
In consideration of the mutual covenants contained herein and pursuant to the authority
permitted under Chapter 791 of the Texas Government Code, the Interlocal Cooperation Act, City
of Denton and NTRLS agree as follows:

The City of Denton wishes to enter into this Interlocal Agreement to authorize participation
in various NTRLS agreements for the purchase of Library books and related supplies or services.
The participation in this cooperative program will be highly beneficial to the taxpayers through the
anticipated savings to be realized.
• II.
v D»<r_a_tion of Agreement
This agreement, which terminates as of its effective date, all prior agreements, written or oral,
between the parties concerning the same services/materials, shall become effective on
, 1997, and shall continue in full force and effect thereafter until terminated
by either party on thirty (30) days written notice to the other.
III.
~~lation___shin ofPartie~
The parties intend that the entity, in receiving products and/or services specified in this
agreement, shall act as an independent purchaser and shall have control of its needs and the manner
in which they are acquired. Neither the City of Denton, its agents, employees, volunteer help or any
other person operating under this agreement shall be considered an agent or employee of NTRLS
and shall not be entitled to participate in any pension plans or other benefits that NTRLS provides
its employees.

Should NTRLS determine to advertise for the purchase of certain goods or services, and offer to the
City the option to purchase such goods or services and City wishes to participate in such bid, then:
1. NTRLS shall advertise for the purchase of such goods or services in compliance
with all applicable State bidding statues.
2. The City shall make payment for the purchase of such goods or services directly
to the lowest responsible bidder from current revenues available for such purchase.
3. The City shall receive all benefits provided by the successful vendor for the goods
or services the City determines to purchase.
