Exhibit 1 - Agenda Information SheetCity of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance CFO: Antonio Puente, Jr. DATE: December 3, 2019 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a third amendment to a Professional Services Agreement between the City of Denton and Freese and Nichols, Inc., amending the contract approved by City Council on December 5, 2017, in the not-to-exceed amount of $1,529,180, amended by Amendments 1-2 approved by Purchasing staff, said third amendment to provide additional engineering services related to the Phase II upgrade of the Lake Lewisville water treatment plant (LLWTP), zebra mussels control measures for both Lake Ray Roberts and Lake Lewisville raw water pump stations, and LLWTP sludge dewatering facility in the amount of $419,980; providing for the expenditure of funds therefor; and providing an effective date (RFQ 6305 – providing for an additional third amendment expenditure amount not-to-exceed $419,980, with the total contract amount not-to-exceed $1,989,530). The Public Utilities Board recommends approval (7 - 0). RFQ INFORMATION/BACKGROUND The City Council approved a contract with Freese and Nichols. Inc. (FNI) for the design, bid phase, and construction services for Phase II rehabilitation of the Lake Lewisville water treatment plant (LLWTP) and zebra mussels control measures for both Lake Ray Roberts and Lake Lewisville raw water pump stations; authorizing the expenditure of funds in an amount not-to-exceed $1,529,180. Since then there were two previous amendments to the contract: • Amendment No. 1: Design separate building for High Service Pump Station (HSPS) Electrical and Administrative facilities, extend active survey boundary east to accommodate new Administration Building, provide related surveying, geotechnical, and structural design services in the amount of $21,965, increasing the contract. • Amendment No. 2: design replacement of Clearwell Area and HSPS sump pump discharge, including electrical power supply, design addition of Drip-master pump lubrication systems for Lake Lewisville raw water pumps, design integrated sump pump system for Lake Lewisville raw water pump station discharge vaults in the amount of $18,405, increasing the contract. Amendment 3 includes: • Resident project representative services for Lake Lewisville water treatment plant Phase II upgrade and Lake Lewisville dewatering facility for a total amount of $419,980. • Resident project representative services for Lake Lewisville water treatment plant Phase II upgrade. Up to 12 hours per week for the first month and last month of construction. Up to 24 hours per week City Hall 215 E. Up to 8 hours per week for the first month and last month of construction. Up to 16 hours per week for the remaining 10 months of construction (12 months total part-time resident representation for $126,492.00). PRIOR ACTION/REVIEW (Council, Boards, Commissions) On December 5, 2017, City Council approved a contract with Freese and Nichols, Inc., in the not-to-exceed amount of $1,529,180 (Ordinance 2017-378). On August 8, 2018, Purchasing approved a first amendment with Freese and Nichols, Inc., in the not-to- exceed amount of $21,965. On January 1, 2019, Purchasing approved a second amendment with Freese and Nichols, Inc., in the not- to-exceed amount of $18,405. On November 11, 2019, the Public Utilities Board (PUB) recommended this item to the City Council for consideration. RECOMMENDATION Award Amendment No. 3 with Freese and Nichols, Inc., for additional services related to the Resident Project Representative (RPR) for Lake Lewisville water treatment plant Phase II upgrade and Lake Lewisville dewatering facility projects, in the not-to-exceed amount $419,980, for a total amended contract amount of $1,989,530. PRINCIPAL PLACE OF BUSINESS Freese and Nichols, Inc. Fort Worth, TX ESTIMATED SCHEDULE OF PROJECT This project will be started upon approval with a completion date by April 2021. FISCAL INFORMATION These services will be funded from the following account numbers: LLWTP Phase II Upgrade account # 630344517 will fund the amount of $1,569,579 and LLWTP Phase II Upgrade account #630344523 will fund the amount of $419,980. Purchase Order #184110 will be increased in the Purchasing software system in the amount of $419,980. The budgeted amount for this item is $1,989,530.
