Exhibit 1 - Agenda Information Sheet - Amendment 1City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance CFO: Antonio Puente, Jr. DATE: June 23, 2020 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a first amendment to a Professional Services Agreement between the City of Denton and Brandstetter Carroll, Inc., amending the contract approved by City Council on May 21, 2019, in the not-to-exceed amount of $3,085,830; said first amendment to provide additional professional design and engineering services for the Expansion of Police Headquarters, Public Safety Dispatch Area, and a New Police Substation, and the added scope for design and engineering services for a new Police Firing Range; providing for the expenditure of funds therefor; and providing an effective date (RFQ 7008 – providing for an additional first amendment expenditure amount not-to-exceed $649,650, with the total contract amount not-to-exceed $3,735,480). INFORMATION/BACKGROUND The City of Denton’s Public Safety projects consist of the renovation of the existing headquarters building to bring it up to standards of the industry and accommodate a more efficient layout; a new remote substation to address the identified need in that location; and indoor firing range to allow the city the proper training of the public safety staff. These projects were part of the recent bond passed November 5, 2019. The design team, headed by Brandstetter Carroll, Inc., was awarded the contract for the design and engineering services for these three public safety projects in second quarter of 2019. They were authorized to complete conceptual design through August 1, 2020, and then suspended work pending the decision of the voters. Design work re-commenced immediately upon bond vote certification, and currently continues to stay on schedule. The current contract included design and engineering services for the Police Department Headquarters Renovation and the new Substation. The City requested Brandstetter Carroll, Inc. to add a 18,600 SF Firing Range training facility to their scope of work in late 2019. In 2020, the City also requested Brandstetter Carroll, Inc. to provide surveying of and civil engineering for improvements on a recently acquired parcel adjacent to the Police Department Headquarters. The design and engineering assistance for the consideration of multiple options, including several different Police Department Headquarters facades, tower heights, and solar energy/energy conservation measures was also requested by the City. McKinney Street Denton, Texas www.cityofdenton.com The fees requested have been validated Peak Program Value, LLC, the City’s project controls consultant, after negotiations and confirmation that the fees requested are in line with market value for similar design and engineering services. The negotiations with Brandstetter Carroll, Inc. resulted in the AIA G802 Amendment to the Professional Services Agreement, which provides compensation for these additional design and engineering services. PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On November 19, 2019, Council approved the use of Construction Manager at Risk (CMAR) delivery method for the construction of the Public Safety Facilities (Resolution 19-2440). On May 21, 2019, Council approved a Professional Services Agreement with Brandstetter Carroll, Inc., in the not-to-exceed amount of $3,085,830 (Ordinance 19-1114). On April 21, 2020, Council approved a Construction Manager as Constructor Agreement with Byrne Construction Services for Construction Manager at Risk (CMAR) preconstruction services for the renovation of Police Headquarters, and development of the Police Substation and Firing Range, in the not- to-exceed amount of $45,000 (Ordinance 20-853). RECOMMENDATION Award Amendment No. 1 with Brandstetter Carroll, Inc., to provide additional professional design and engineering services for the Expansion of Police Headquarters, Public Safety Dispatch Area, and a New Police Substation, and the added scope for design and engineering services for a new Police Firing Range, in the not-to-exceed amount $649,650, for a total amended contract amount of $3,735,480. PRINCIPAL PLACE OF BUSINESS Brandstetter Carroll, Inc. Dallas, TX ESTIMATED SCHEDULE OF PROJECT The preconstruction services in this contract will be complete by first quarter of 2021, barring further unforeseen circumstances; or suspension of services by the City for convenience. The construction administration services of Brandstetter Carroll under this contract will be completed by the second quarter of 2022, also barring further unforeseen circumstances; or suspension of services by the City for convenience. FISCAL INFORMATION These services will be funded from G.O. (City Facilities Projects) – Fund 468 account 100264468, C.O. (City Facilities Projects) – Fund 409 account 100264409, C.O. (City Facilities Projects) – Fund 473 account 100277473 and Police Firing Range Project account 100198409. Purchase Order #190033 has already been entered into the Purchasing software system. The budgeted amount for this item is $3,735,480.
