SUBJECT
Consider adoption of an ordinance of the City of Denton, Texas, Nunc Pro Tunc, correcting an inadvertent
mistake in Ordinance No. 20-868, specifically the awarded vendor of the professional services agreement
with ACP/Green + Associates, LLC dba Planning Next for the preparation of a comprehensive plan,
evaluation report, and to update the comprehensive plan; providing an effective date (File 7196).
INFORMATION/BACKGROUND
On May 5, 2020, City Council received a staff recommendation to reject all bids for the preparation of a
comprehensive plan evaluation report and to update the comprehensive plan. Due to an inadvertent clerical
mistake, the incorrect Ordinance No. 20-868 (exhibit 2) was executed.
The executed ordinance (exhibit 2) was previously revised after the Procurement Department put a hold on
the item due to the COVID 19 pandemic in April 2020 per the City Manager’s Office. The ordinance
rejecting the requests for qualifications was entered into the agenda management software in May 2020 and
went through the proper electronic review and posting process. While the correct ordinance was reviewed
and approved by Council, an incorrect hard copy version was provided to the Mayor for signature.
During this timeframe the organization was in the process of fine-tuning remote operations and has since
adjusted the process accordingly.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On May 5, 2020, Council approved an ordinance with ACP/Green + Associates, LLC dba Planning Next
(Ordinance 20-868).
RECOMMENDATION
Approval of an ordinance to reflect the rejection of any and all proposals under RFQ 7196 for professional
services for the preparation of a comprehensive plan evaluation report and to update the comprehensive
plan.
