Exhibit 1 - Agenda Information Sheet - Amendment 2City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance ACM: David Gaines DATE: May 4, 2021 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a second amendment to a contract between the City of Denton and Rey-Mar Construction, amending the contract approved by City Council on May 21, 2019, in the not-to-exceed amount of $3,418,000.00; amended by Amendment 1 approved by Purchasing; said second amendment to providing additional construction services for the Hickory Creek Lift Station; providing for the expenditure of funds therefor; and providing an effective date (File 6894 – providing for an additional second amendment expenditure amount not-to-exceed $128,170.68, with the total contract amount not-to-exceed $3,555,833.36). The Public Utilities Board recommends approval (6 - 0). INFORMATION/BACKGROUND The existing Hickory Creek Lift Station pumps all the wastewater flows from the Hickory Creek sewer basin into the State School Interceptor sewer that conveys the flows to the Pecan Creek Water Reclamation Plant. This lift station was put in service in 1983. The electrical and electronic components of the station are outdated, and the initial pump station design is deficient as it creates a backup in the Hickory Creek Interceptor Sewer under normal operating conditions. In addition, there have been service interruptions at this lift station in 2018 causing large sewer overflows. Cost comparison showed that it was more expensive to upgrade the existing station compared to constructing a new station. On May 21, 2019, the City Council authorized the construction contract with Rey-Mar Construction to begin constructing the new Hickory Creek Lift Station. As part of the last few tasks of the overall construction project, there is a planned lift station bypass for a period of 7 to 10 days where a section of the existing wastewater system will be bypassed using temporary pumps and pipes. This will allow the contractor to work within the by-passed section and replace crucial segments of wastewater infrastructure. Consistent with the original design, the construction contract includes cost estimates for a basic by-pass plan but given the critical role of the Hickory Creek Lift Station in the City’s overall wastewater system, a robust plan (with certain fail-safe components) is required. Additionally, as part of the FM 2181 (Teasley Drive) wastewater relocation project, staff had recently (6 months ago) experienced significant issues with a similar basic by-pass on the downstream side of the Hickory Creek Lift Station. As such, staff recommends moving forward with a robust by-pass plan which will incur additional costs. The additional cost of the added elements related to the by-pass as well as certain other minor changes that are included in the change order is listed below. City Hall 215 E. On December 2, 2019, Purchasing approved Amendment No. 1 with Rey-Mar Construction, in the not-to- exceed amount of $9,662.68. On April 26, 2021, the Public Utilities Board (PUB) recommended this item to the City Council for consideration. RECOMMENDATION Award Amendment No. 2 with Rey-Mar Construction, to provide additional construction services for the Hickory Creek Lift Station, in the not-to-exceed amount of $128,170.68, for a total amended contract amount not-to-exceed $3,555,833.36.
