SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager, or their designee, to execute a contract with Probe America, Inc., for Odor
Control Chemicals for the City of Denton Landfill; providing for the expenditure of funds therefor; and
providing an effective date (RFP 7614-1 – awarded to Probe America, Inc., for three (3) years, with the
option for two (2) additional one (1) year extensions, in the total five (5) year not-to-exceed amount of
$150,000.00). The Public Utilities Board recommends approval (5 - 0).
INFORMATION/BACKGROUND
The City owns and operates a 252 acre Type I Municipal Solid Waste (MSW) landfill which disposes of an
average of 1,100 tons per day of MSW as reported by the Paradigm system. The landfill site is co-located
on a larger city-owned tract of land that houses the City’s wastewater treatment plant and a composting
facility that composts dewatered wastewater treatment plant sludge (bio-solids) and wood waste. All of
these facilities are potential sources of odors.
Under the Texas Municipal Solid Waste regulations, 30 Texas Administrative Code 330.149, and the issued
Texas Commission of Environmental Quality permit 1590A, the facility is required to have an odor
management plan. The Solid Waste Department takes a proactive role in addressing odor complaints and
reducing or eliminating the source of odor generation. Implementation of best management practices at the
facilities has reduced the frequency of odor complaints, but during certain periods of the year, the prevailing
winds often change to a direction that blows odors to the more populated areas. During these periods, the
landfill operators are on the lookout for waste that characteristically may produce an odor (such as sludges,
animal carcasses, and wet restaurant waste) so they can immediately bury the potentially odiferous or
noxious waste. Staff routinely utilizes odor control chemicals to prevent odors from migrating beyond the
permit boundary. The landfill currently has a Dry Vapor Odor Control System with 3000’ of piping installed
along the east side and south end of the landfill property that is in operation 24/7 to help neutralize odors
before leaving the site as the last line of defense. We also use the AiroPure odor destructive reagent mixed
in the water truck to actively spray around the site as needed to help neutralize various noxious odors before
they can have a chance to leave the site causing an odor complaint.
Other products have been used on a trial basis; however, they were ineffective because they did not
neutralize the odor. Staff recommends the purchase of AiroPure from Probe America which is an odor-
destructive reagent (ODR), which is a new sophisticated science that interacts with odor molecules on a
molecular level to destroy them completely and immediately. AiroPure is unique and is independently

proven to be highly effective against an entire spectrum of malodor compounds which will help the landfill
staff manage odors on site. AiroPure is a proprietary blend distributed exclusively by Probe America;
therefore, Probe America is the sole source vendor of this product.
Request for Proposals was sent to 127 prospective suppliers of this item. In addition, specifications were
placed on the Materials Management website for prospective suppliers to download and advertised in the
local newspaper. Three (3) proposals were received, with two (2) meeting specifications. References were
checked, and proposals were evaluated based upon published criteria including schedule, compliance with
specifications, probable performance, and price. Best and Final Offers (BAFO) were requested from the top
firm. Based upon this evaluation, Probe America, Inc. was ranked the highest and determined to be the best
value for the City.

On May 24, 2021, the Public Utilities Board (PUB) recommended this item to the City Council for
consideration.
RECOMMENDATION
Award a contract with Probe America, Inc., for Odor Control Chemicals for the City of Denton Landfill, in
a three (3) year, with the option for two (2) additional one (1) year extensions, in the total five (5) year not-
to-exceed amount of $150,000.
