Exhibit 1 - Agenda Information Sheet City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance ACM: David Gaines DATE: July 20, 2021 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a second amendment to a Professional Services Agreement between the City of Denton and Kirkpatrick Architecture Studio, amending the contract approved by City Council on April 18, 2017, in the not-to-exceed amount of $652,200.00; amended by Amendments 1 and 2 approved by Purchasing; said second amendment to provide additional materials testing, management, and HVAC system balancing for Fire Station 3; providing for the expenditure of funds therefor; and providing an effective date (File 6318 – providing for an additional second amendment expenditure amount not-to- exceed $13,664.40 with the total contract amount not-to-exceed $715,654.63). INFORMATION/BACKGROUND On April 18, 2017, City Council approved a contract for $652,200 for professional architectural design services for the design of Fire Station #3. On May 28, 2018, Facilities Management received a small dollar proposal from Kirkpatrick Architecture Studio for additional materials testing and management, which was processed via purchase order for $11,017.90 without a formal amendment. Changes to the contract under $50,000 are within Purchasing’s authority, and as of 2019, all changes to a contract regarding additional work, quantities, or price require a formal amendment. The first formal amendment’s purpose was to address the need for testing, adjusting, and balancing services for the HVAC system and provide materials testing and observation services for Fire Station #3 in the amount of $38,772.33. This second amendment will address additional testing, adjusting, and balancing needs for the HVAC system as well as additional materials testing, and management required to complete services in the amount of $13,664.40. PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On April 18, 2017, City Council approved a contract with Kirkpatrick Architecture Studio, in the not-to- exceed amount of $652,200 (Ordinance 17-126). RECOMMENDATION Award Amendment No. 2 with Kirkpatrick Architecture Studio, additional materials testing, management, and HVAC system balancing for Fire Station 3, in the not-to-exceed amount of $13,664.40, for a total amended contract amount of $715,654.63. PRINCIPAL PLACE OF BUSINESS Kirkpatrick Architecture Studio Denton, TX ESTIMATED SCHEDULE OF PROJECT This project will be started upon approval with a completion date within two (2) months.
