SUBJECT
Consider adoption of an ordinance of the City of Denton, Texas, a Texas home-rule municipal corporation,
authorizing the approval of Change Order No. 1 to the contract between the City of Denton and Floyd Smith
Concrete, Inc. for the concrete slab extension of existing compost windrows; providing for the expenditure
of funds therefor; and providing an effective date (IFB 6547- Change Order No. 1 in the amount of
$220,233.87 for a total contract award aggregating to $22,196,495.71). The Public Utilities Board
recommends approval (6-0).
BACKGROUND
The compost operation at the Pecan Creek Water Reclamation Plant (PCWRP) site was started in Denton
to divert away from the landfill, the biosolids produced at the plant and the yard waste collected by the
Solid Waste department. This diversion allowed preservation of the expensive landfill capacity, and at the
same time by composting the diverted stream created a beneficial reuse of the products. The Denton
compost produced by using the diverted biosolids and the yard waste is sold as the trade name Dyno Dirt
along with several other products produced at the compost operation. Exhibit 2 shows the windrow piles
where the biosolids and yard waste is combined for the compost operation.
The compost operation was started in 1997, with a major expansion of the operation in the 2001 PCWRP
expansion project. During that expansion, a concrete area for additional windrows and storing of curing
piles and finished products were added. Since the 2001 expansion project, the biosolids quantity produced
at the plant has increased. In addition, the PCWRP was required by regulatory agencies in 2013 to meet the
phosphorous limit of 0.5 milligrams per liter (mg/l) by June 2016. To meet the 0.5 mg/l limit, plant process
had to be redesigned to accommodate the addition of ferric chloride to settle out the excess phosphorous.
This settling of excess phosphorous adds additional solids in the waste stream that go to the compost
operation. This additional solids waste stream along with the increase in solids production since the 2001
plant expansion has created the need to expand the concrete area for the windrows.
Exhibit 2 shows the proposed expansion of the concrete area which is essentially the extension of the
existing windrows concrete area. The total area of the proposed expansion is about 2,808 square feet. The
wastewater department is proposing to use the current annual concrete contractor Floyd Smith Concrete,
Inc. for the expansion project. In accordance with Local Government Code 252.048, change orders in excess
of $50,000 require City Council approval. The net change presented does not exceed 25 percent of the
original contract value.

The cost proposal from the contractor is attached as Exhibit 3. The contractor has estimated no greater than
$3,000 for the cost of additional payment and performance bonds required for the expansion project. The
total project cost will not exceed $220,233.87.
PRIOR ACTION/REVIEW
On October 17, 2017, Council approved a public works contract with Floyd Smith Concrete, Inc. in the
amount of $21,976,261.71 (Ordinance 2017-321).
RECOMMENDATION
Staff recommends the approval of the Change Order No. 1, enabling the City of Denton to proceed with the
construction of the extension of existing compost windrows.

FISCAL INFORMATION
The project resides in the Wastewater Collection bond funds account 640377541 and total project costs are
budgeted at $220,233.87. Requisition # 138510 has been entered into the Purchasing software system in
the amount of $220,233.87.
