Agenda Information SheetCity of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance ACM: David Gaines DATE: March 1, 2022 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager to execute a contract with Innovyze LLC, for software services for the Water Utilities Department, which is the sole provider of this software, in accordance with Texas Local Government Code 252.022, which provides that procurement of commodities and services that are available from one source are exempt from competitive bidding, and if over $50,000, shall be awarded by the governing body; providing for the expenditure of funds therefor; and providing an effective date (File 7879 – awarded to Innovyze LLC, for three (3) years, with the option for two (2) additional one (1) year extensions, in the total five (5) year not-to-exceed amount of $150,000.00). The Public Utilities Board recommends approval (6-0). INFORMATION/BACKGROUND The City of Denton Water Utilities Department uses specialized software to manage hydraulic modeling and analytics relating to asset reinvestment for over 1,100 miles of water and sewer mains across the City. Hydraulic modeling drives capital project identification and allows for accurate assessment of demand load brought on by new development. The current hydraulic modeling software application for Wastewater Collections, InfoWorks ICM, was first purchased from Innovyze under the current licensing levels in 2017 and continues to be utilized. The current hydraulic modeling software application for Water Distribution, InfoWater, was purchased from Innovyze under the current licensing levels in 2018 and also continues to be utilized. Collaboration with Technology Services determined that, due to the significant investment in the models housed in these applications, each has a life cycle of 10 (ten) years, at which point a competitive survey of the market would be appropriate. The third software application in this package is InfoAsset Planner, a platform that mines multiple data sources assessing the risk and condition of all water and sewer mains in the City. Water Utilities uses InfoAsset Planner to drive asset rehabilitation and replacement decisions, including targeted inspection and research efforts. InfoWorks ICM was first purchased from Innovyze in 2019 and continues to be utilized and further developed. Collaboration with Technology Services determined that this application also has a life cycle of 10 (ten) years, at which point a competitive survey of the market would be appropriate. Together, these three applications have driven most capital investment decisions since their procurement. In 2021, it was determined that the ongoing licensing and support payments had risen to a level that requires a contract, and accordingly, a contract was drafted between the City of Denton and Innovyze LLC, which City Hall 215 E. McKinney Street Denton, Texas www.cityofdenton.com is now pending approval. These software licensing and support payments are considered Sole Source based on review and approval from the City’s internal Solicitation Review Committee. PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On February 17, 2022, the Public Utilities Board (PUB) recommended this item to the City Council for consideration. RECOMMENDATION Award with a contract to Innovyze LLC, as a sole source supplier, for software services for the Water Utilities Department, in a three (3) year, with the option for two (2) additional one (1) year extensions, in the total five (5) year not-to-exceed amount of $150,000. PRINCIPAL PLACE OF BUSINESS Innovyze LLC San Rafael, CA ESTIMATED SCHEDULE OF PROJECT This is an initial three (3) year contract with options to extend the contract for two (2) additional one (1) year periods, with all terms and conditions remaining the same.
