AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPALCORPORATION, AUTHORIZING THE APPROVAL OF CHANGE ORDER NO. 3 TO THE CONTRACT BETWEEN THE CITY OF DENTON AND QUALITY EXCAVATION, LTD, FORADDITIONAL WORK ON THE 2019 INTERSECTION IMPROVEMENTS PROJECT;PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN EFFECTIVE DATE (nB 7413 – CHANGE ORDER NO. 3, 1N THE NOT-TO-EXCEEDAMOUNT OF $309,521.05, FOR A TOTAL CONTRACT AWARD AGGREGATED TO $2,119,091.68). WHEREAS, on December 1, 2020, by Ordinance No. 20-2201, the City Council awarded a contract to Quality Excavation, LTD, in the amount of $1,809,570.63, for the 2019 Intersection Improvements Project; and WHEREAS, on July 12, 2021, Purchasing awarded a Change Order No. 1 between the City of Denton and Quality Excavation, LTD, using contingency funds in the amount of $25,53 1.54; and WHEREAS, on October 4, 202 1 , Purchasing awarded Change Order No. 2 between the City of Denton and Quality Excavation, LTD, using contingency funds in the amount of $60,590.36; and WHEREAS, the Staff having recommended, and the City Manager having recommended to the Council that a change order be authorized to amend such contract agreement with respect to the scope of work and an increase in the payment amount; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. Change Order No. 3, increasing the amount of the contract between the City and Quality Excavation, LTD, which is on file in the office of the Purchasing Agent, in the amount of Three Hundred Nine Thousand Five Hundred Twenty-One and 5/100 ($309,521.05) dollars, is hereby approved, and the expenditure of funds therefore is hereby authorized in accordance with saidchange order which shall be attached hereto. The total purchase order amount increases to $2,119,091.68. SECTION 2. This ordinance shall become effective immediately upon its passage and approval.
