22-2198 - 7163 - Change Order 4 Ordinance ExecutedORDINANCE NO. 22-2 198 AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNiCmAL CORPORATION, AUTHORIZING THE APPROVAL OF CHANGE ORDER NO. 4 TO THECONTRACT BETWEEN THE CITY OF DENTON AND 2L CONSTRUCTION, LLC, FOR THEWEST HICKORY STREET PAVING, LIGHTING & DRAINAGE MPROVEMENTS PROJECTFOR THE CITY OF DENTON; PROVIDING FOR THE EXPENDITURE OF FUNDSTHEREFOR; AND PROVIDING AN EFFECTIVE DATE (IFB 7163 – CHANGE ORDER NO. 4IN THE NOT-TO-EXCEED AMOUNT OF $219,543.05, FOR A TOTAL CONTRACT AWARD AGGREGATED TO $2,139,047.00). WHEREAS, on July 28, 2020, by Ordinance No. 20- 1309, the Council awarded a contract to 2L Construction, LLC, in the amount of $1,919,503.95 for West Hickory Street Paving, Lighting & Drainage Improvements Project; and WHEREAS, on January 6, 2021, Purchasing awarded a Change Order No. 1 to 2L Construction, LLC, in the amount of $11,554.00; and WHEREAS, on April 30, 2021, Purchasing awarded a Change Order No. 2 to 2L Construction, LLC, in the amount of $22,740.50; and WHEREAS, on October 1, 2021, Purchasing awarded a Change Order No. 3 to 2L Construction, LLC, in the amount of $17,901.00; and WHEREAS, this procurement was undertaken as part of the City’s governmental function; and WHEREAS, the Staff having recommended, and the City Manager having recommended to the Council that a change order be authorized to amend such contract agreement with respect to the scope of work and an increase in the payment amount; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. Change Order No. 4, increasing the amount of the contract between the City and 2L Construction, LLC, which is on file in the office of the Purchasing Agent, in the amount of Two Hundred Nineteen Thousand Five Hundred Forty-Three and 05/100 ($219,543.05) dollars, is hereby approved and the expenditure of funds therefore is hereby authorized in accordance with said change order. The total purchase order amount increases to $2,139,047.00. SECTION 2. This ordinance shall become effective immediately upon its passage and approval.
