Exhibit 1 - Agenda Information SheetCity of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement INTERIM ACM: Cassey Ogden DATE: January 24, 2023 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager to execute a contract with McCarthy Building Companies, Inc., for the construction of the Mayhill Road Phase 2 Project; providing for the expenditure of funds therefor; and providing an effective date (CSP 8092 – awarded to McCarthy Building Companies, Inc., in the not-to- exceed amount of $20,469,433.55). INFORMATION/BACKGROUND The Mayhill Road Project is a roadway project that, once complete, will increase the carrying capacity of Mayhill Road by creating a continuous four-lane divided roadway between US 380 and IH 35 E. Mayhill Phase 1 extended from US 380 to the north of Quail Creek Road and construction was completed in October 2020. The Mayhill Rd Phase 2 Project will extend the existing Mayhill Road on a new location from Phase 1 to Colorado Boulevard as a 4-lane road with a 4-lane bridge over the rail (with a future option to widen to a 6-lane), new side paths, and trails (5-10 feet), traffic signals, street lighting, and a regional flood control structure. On February 18, 2010, the City of Denton (“City”) and the Texas Department of Transportation (“TxDOT”) entered into an Advance Funding Agreement (“AFA”) for the expansion of Mayhill Road from a two-lane rural road to a four-lane divided urban arterial roadway from IH 35E to US 380 (CSJ 0918-46-246). On October 19, 2010, City Council approved a contract with Freese and Nichols, Inc. for the design of the Mayhill Road Widening and Improvements project from US 380 through Colorado Boulevard. The Mayhill Phase 2 Project has a total project cost of $20,469,433.55. This estimate includes a $19,494,698.62 total base proposal amount and a five (5) percent contingency amount of $974,734.93. The five (5) percent contingency allowance is for the sole use of the City and will be subject to written authorization by the City’s Project Manager and Program Manager. McCarthy Building Companies was selected as the contractor during the Competitive Sealed Proposal process based on the company’s key personnel, reputation & ability to complete similar projects, detailed schedule, safety record, and proposal cost. The selected contractor rated in the range of above average to superior in all categories. The detailed schedule and written plan were presented thoroughly with a focus on critical path scheduling and action plans. Key personnel requirements submitted were in-depth on the City Hall 215 E. The evaluation team combined category scoring and proposal price of all nine (9) offerors to make the selection of McCarthy Building Companies. Competitive Sealed Proposals were sent to 917 prospective suppliers, including 69 Denton firms, of this item. In addition, specifications were placed on the Procurement website for prospective suppliers to download and advertised in the local newspaper. Nine (9) proposals were received and were evaluated based upon published criteria including key personnel, quality, reputation, ability to complete projects on schedule and within budget, detailed schedule and written plan, safety record, and price. Best and Final Offers (BAFO) were requested from the top firm. Based upon this evaluation, McCarthy Building Companies, Inc. was ranked the highest and determined to be the best value for the City.
