23-510 - 6778 - Amendment 2 Ordinance ExecutedORDINANCE NO. 23-5 10 AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL CORPORATION, RATIFYING THE EMERGENCY APPROVAL OF A SECONDAMENDMENT TO A CONTRACT BETWEEN THE CITY OF DENTON AND TECHLINE,INC., AMENDING THE CONTRACT APPROVED BY THE CITY COUNCIL ON SEPTEMBER 18, 2018, IN THE NOT-TO-EXCEED AMOUNT OF $11,000,000.00; AMENDED BYAMENDMENT 1 APPROVED BY CITY COUNCIL; SAID SECOND AMENDMENT TO PROVIDE ADDITIONAL SPEND AUTHORITY FOR TRANSFORMER PURCHASES FOR THEDENTON MUNICIPAL ELECTRIC DEPARTMENT; PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN EFFECTIVE DATE (IFB 6778 – PROVIDINGFOR AN ADDITIONAL SECOND AMENDMENT EXPENDITURE AMOUNT NOT-TO-EXCEED $1,000,000.00, WITH THE TOTAL CONTRACT AMOUNT NOT-TO-EXCEED $14,750,000.00). WHEREAS, on September 18, 2018, by Ordinance No. 18-1478, the City awarded a contract to Techline, Inc., in the amount of $11,000,000.00, for transformer purchases for the Denton Municipal Electric Department; and WHEREAS, on June 28, 2022, by Ordinance No. 22-1247, the City awarded a First Amendment to Techline, Inc., in the amount of $2,750,000.00, for additional transformer purchases for the Denton Municipal Electric Department; and WHEREAS, this procurement was undertaken as part of the City’s governmental function; and WHEREAS, the additional fees under the proposed Second Amendment are fair and reasonable and are consistent with, and not higher than, the recommended practices and fees applicable to the Provider’s profession, and such fees do not exceed the maximum provided by law;NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The Second Amendment, increasing the amount of the contract between the City and Techline, Inc., which is on file in the office of the Purchasing Agent, in the amount of One Million and 0/100 ($ 1,000,000.00) Dollars, is hereby approved and the expenditure of funds therefor is hereby authorized in accordance with said amendment which shall be attached hereto. The total contract amount increases to $14,750,000.00. SECTION 2.
