SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager to execute a contract with Kirby-Smith Machinery, Inc., an authorized dealer
for Komatsu America Corp., through the Sourcewell Cooperative Purchasing Network Contract Number
032119-KOM, for the purchase of one (1) Komatsu Wheel Loader for the Water and Wastewater
Departments; authorizing the expenditure of funds therefor; and providing an effective date (File 8298 –
awarded to Kirby-Smith Machinery, Inc., in the not-to-exceed amount of $290,000.00). The Public Utilities
Board recommends approval (4 - 0).

INFORMATION/BACKGROUND
This request is in consideration of a contract with Kirby-Smith Machinery, Inc. to provide one Komatsu
WA320-8 Wheel Loader. The Wheel Loader is used in the sand pit by the Water and Wastewater
Departments to load trucks with sand and gravel to be delivered to job sites.
The current Wheel Loader is a 2013 model that has 12.7 points on the 15-point replacement scale.
Kirby Smith Machinery, Inc. sells direct to the customer and provides cooperative contract pricing on the
Sourcewell contract number 032119-KOM.
A 10% contingency has been added due to the vulnerable market, bringing the total contract amount to
$290,000.

Pricing obtained through Sourcewell Cooperative Purchasing Network has been competitively bid and
meets the statutory requirements of Texas Local Government Code 271.102.

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On January 28, 2020, Council approved the interlocal agreement with Sourcewell (Ordinance 20-197).
On July 24, 2023, the Public Utilities Board (PUB) recommended this item to the City Council for
consideration.
RECOMMENDATION
Award a contract with Kirby-Smith Machinery, Inc., for the purchase of one (1) Komatsu Wheel Loader
for the Water and Wastewater Departments, in a not-to-exceed $290,000.
