Exhibit 1 - Agenda Information SheetCity of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement ACM: Cassey Ogden DATE: August 1, 2023 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager to execute a contract with Armstrong Forensic Laboratory, Inc., for controlled substance identification, blood alcohol testing, and related services for the Police Department; providing for the expenditure of funds therefor; and providing an effective date (RFQ 8231 – awarded to Armstrong Forensic Laboratory, Inc., for one (1) year, with the option for four (4) additional one (1) year extensions, in the total five (5) year not-to-exceed amount of $150,000.00). INFORMATION/BACKGROUND The Police Department’s Forensics Division requires forensic testing for law enforcement purposes which includes the identification and quantitative analysis of controlled substances and pharmaceuticals in evidence samples. Forensic testing services are performed to detect potential, toxicants and intoxicants such as chemicals, drugs, and alcohol through the testing of material and blood samples. The City uses vendor-provided controlled substance identification, blood alcohol, and toxicology services because it does not have the facilities, equipment, and qualified professionals required to perform the scientific testing of evidence to detect the presence or absence, quantitatively and/or qualitatively, of potential toxicants or intoxicants, such as chemicals, alcohol, drugs, or other controlled substances. A qualified vendor is needed to provide these services. The testing of THC will be utilized on a case-by-case basis for the investigation of a felony level narcotics case that has been designated as a high-priority investigation, the investigation of a violent felony, and those specific scenarios where the testing of a misdemeanor offense may be necessary to make the case of a higher criminal charge such as possession of illegal guns, previous felony convictions, etc. The Texas Department of Public Safety's Crime Laboratory, while a free service to the City, has limitations on the testing services it provides to law enforcement agencies in the State, causing the City to utilize vendor-provided forensic services in order to fully support criminal investigations. In April 2020, the City entered into a Professional Services Agreement (PSA) with Armstrong Forensic Laboratory, Inc. (AFL) of Arlington, Texas to provide the necessary testing services. The limits of the purchase order under the Agreement (PSA) have been met and require a new procurement. City Hall 215 E. In addition, the RFQ was placed on the Procurement website for prospective respondents to download, and advertised in the local newspaper. Two (2) statements of qualifications (SOQ) were received. The SOQs were evaluated based on published criteria including delivery/project schedule, compliance with specifications, and probable performance. Based upon this evaluation, the recommended award is to Armstrong Forensic Laboratory, Inc., and is determined to be the most qualified firm for the City. FISCAL INFORMATION These services will be funded from Investigations Home Business Unit, account 310102.7898 and a requisition will be entered into the Purchasing software system in the amount of $20,000 in fiscal year 2024.
