Exhibit 1 - Agenda Information SheetCity of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement ACM: Cassey Ogden DATE: September 19, 2023 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager to execute a contract with Abacus Corporation, as the primary vendor, and LC Personnel, Inc. dba Labor Finders, as the secondary vendor, for the use of temporary labor services for various City of Denton Departments for the Purchasing Department; providing for the expenditure of funds therefor; and providing an effective date (RFP 8238 – awarded to Abacus Corporation, the primary, and LC Personnel, Inc. dba Labor Finders, the secondary, in the three (3) year not-to-exceed amount of $525,000.00). INFORMATION/BACKGROUND The proposed contract is for temporary employment services for various operations throughout the City, including but not limited to, parks services, water and wastewater utilities, street construction and repair services, electric utility services, and landfill operations on an as-needed basis. The contract provides departments with temporary labor for seasonal or project-based tasks that do not require a full-time position. The primary users of the contract are the Solid Waste Department and the Parks and Recreation Department. The Solid Waste Department uses temporary labor services to supplement waste collections during seasonal highs such as holidays and the spring when bulk waste and yard waste increase. Approximately $83,000 has been spent in the current fiscal year (FY) for Solid Waste. Parks and Recreation utilize additional labor services seasonally as well as for mowing, maintenance of athletic fields, and special event assistance. The fiscal year-to-date expenditure by Parks is just over $73,000. The contract is available for use by other City departments as needed to meet temporary and/or one-time needs. The total expenditure year-to-date in FY 2023 is approximately $156,000. In FY 2022, $173,472 was spent on temporary labor services. The contract has the following assigned skilled levels for the City to request from: Level I – entry-level position with zero to two (2) years of verifiable, applicable experience. Level II- intermediate skill set with two (2) but less than five (5) years of verifiable, applicable experience. Level III – advanced skill set with at least five (5) years of verifiable, applicable experience. Vendor Award Abacus Corporation Primary LC Personnel, Inc. dba. After reference checks, Abacus Corporation and LC Personnel, Inc. dba Labor Finders were selected based on being established businesses that have experience with working with larger entities and possess the competence to perform the work requested in a timely manner. Below is the information provided by both vendors regarding the wages they pay their employees who will be assigned to the City’s contract. The reported rates align with the Ready to Work Program which also provides temporary labor for Solid Waste. In addition, specifications were placed on the Materials Management website for prospective suppliers to download and advertised in the local newspaper. Five (5) proposals meeting specifications were received and evaluated based upon published criteria including compliance with specifications, probable performance, and price. Based upon this evaluation, Abacus Corporation and LC Personnel, Inc. dba Labor Finders was ranked the highest and determined to be the best value for the City.
