Exhibit 1 - Agenda Information Sheet - Amend 1City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement ACM: Cassey Ogden DATE: October 17, 2023 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a first amendment to a Professional Services Agreement between the City of Denton and Burns & McDonnell Engineering Company, Inc., amending the contract approved by City Council on December 14, 2021, in the not-to-exceed amount of $1,500,000.00, said first amendment to continue to provide engineering services for Denton Municipal Electric; providing for the expenditure of funds therefor; and providing an effective date (RFQ 7740 – providing for an additional first amendment expenditure amount not-to-exceed $500,000.00, for a total contract amount not-to-exceed $2,000,000.00). The Public Utilities Board recommends approval (5 - 0). INFORMATION/BACKGROUND There are numerous technical requirements for the electric distribution system which are managed by Denton Municipal Electric’s (DME) Engineering department. Short and long-term studies of the electric distribution system allow DME to proactively identify and correct system deficiencies before they affect the quality of electric service provided to customers. Denton’s current customer growth is positive and significant. DME’s engineers and techs work diligently to design, estimate, and manage multiple projects within the DME service territory; but there are times when outside assistance is beneficial for a timely response. DME maintains a collection of Construction Standards that have been reviewed, approved, and sealed by a Professional Engineer in the State of Texas. As new construction methods and materials are identified that are beneficial to DME’s customers, the Construction Standards will require updates from time to time. It is advantageous for a third party to perform audits of projects. An audit provides a greater understanding of design and construction compliance with Construction Standards and allows for improvements to be made in criteria, practices, or processes. In addition to updating existing construction standards, DME plans to build a 25kV system that requires the development of new construction standards. DME Engineering has utilized a professional services contract to provide engineering services from 2021 to the present. DME has greatly benefited from its expertise in system design, system planning, and the creation and maintenance of new standards. PRIOR ACTION/REVIEW (Council, Boards, Commissions) On December 14, 2021, City Council approved a contract with Burns & McDonnell Engineering Company, Inc., in the not-to-exceed amount of $1,500,000 (Ordinance 21-2691). RECOMMENDATION Award Amendment No. 1 with Burns & McDonnell Engineering Company, Inc., to continue to provide engineering services for Denton Municipal Electric, in a not-to-exceed amount of $500,000, for a total amended contract amount of $2,000,000. Fort Worth, TX SUSTAINABILITY MEASURES DME is seeking this extension to the engineering services contract to obtain assistance with system planning studies and updated construction standards which will reduce waste and improve reliability and resiliency. Relationship to Sustainability Framework As the construction standards are improved and maintained they will help minimize and prevent safety issues and material waste that have been identified in outdated building techniques. System planning studies help to improve electric system reliability and resiliency by identifying undersized equipment (due to load growth) or weak points in the system and implementing corrective actions. ESTIMATED SCHEDULE OF PROJECT This contract expires on December 13, 2024. FISCAL INFORMATION These services will be funded from Electric Operating Funds. Purchase Order #204171 will be revised to include the first amendment amount of $183,063, and Purchase Order #204077 will be revised to include the amended amount of $293,000. The total amount of this contract is $2,000,000.00.
