SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager to execute a contract with Hawk Construction, LLC., for the construction of
precast concrete security/screening walls for Denton Municipal Electric; providing for the expenditure of
funds therefor; and providing an effective date (RFP 8370 – awarded to Hawk Construction, LLC., for three
(3) years, with the option for two (2) additional one (1) year extensions, in the total five (5) year not-to-
exceed amount of $6,000,000.00).

INFORMATION/BACKGROUND
Denton Municipal Electric (DME) has eight (8) substation projects approved in its five (5) year Capital
Improvement Plan (CIP) that require construction of substation precast security walls. Construction of the
precast concrete walls is necessary to provide the required perimeter security for the substations and is
required by the Denton Development Code for all new substation projects. The walls will be constructed
using Verti-Crete precast concrete panels and the panels will be supported by concrete columns mounted
on engineered pier foundations. The design and color will match the existing substation precast concrete
walls.
RFP 8370 was prepared to solicit proposals for the construction of the walls needed in the approved CIP.
The estimated total length of wall construction required for the next three years is 15,000 linear feet. The
average substation wall will be approximately 1,500 to 2,500 linear feet. The perimeter walls will be 10
feet in height. Wall construction does not include gates. Gates will be procured and installed separately.

Request for Proposals was sent to 142 prospective suppliers, including 12 Denton firms. In addition,
specifications were placed on the Procurement website for prospective suppliers to download and advertised
in the local newspaper. One (1) proposal was received, and references were checked to ensure the vendor
could provide the services requested in the Scope of Work. The proposal was evaluated based on published
criteria including schedule, compliance with specifications, probable performance, and price. The
department is awarding the contract to Hawk Construction, LLC.

This item will be presented to the Public Utilities Board (PUB) on February 26, 2024, retroactively, due to
the February 12, 2024 meeting not having a quorum.
RECOMMENDATION
Award a contract with Hawk Construction, LLC., for the construction of precast concrete security/screening
walls for Denton Municipal Electric, in three (3) years, with the option for two (2) additional one (1) year
extensions, in the total five (5) year not-to-exceed amount of $6,000,000.

ESTIMATED SCHEDULE OF PROJECT
This is an initial three (3) year contract with options to extend the contract for two (2) additional one (1)
year periods, with all terms and conditions remaining the same. Delivery of the items will occur within 25
weeks after receipt of the order.
FISCAL INFORMATION
These services will be funded out of amounts budgeted for specific CIP projects. Most of the work proposed
will be in the transmission category. Therefore, these costs for transmission projects will ultimately be
recovered through the Public Utility Commission of Texas, Transmission Cost of Service Program (TCOS).
The budgeted amount for this item is $6,000,000. The City will only pay for services rendered and is not
obligated to pay the full contract amount unless needed.
