HomeMy WebLinkAbout1999-261F \shared\dept\LGL\Our Documents\Ordinances\99\A-85 Ordinance zoning doc ORDINANCE NO 99- a � i AN ORDINANCE OF THE CITY OF DENTON, TEXAS, INITIALLY DESIGNATING TO AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 83 75 ACRES OF LAND IN THE CITY OF DENTON, TEXAS, LOCATED ON THE NORTHWEST CORNER OF THE LOOP 288 AND STUART ROAD INTERSECTION, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE (A-85, MESQUITE MEADOWS) WHEREAS, on April 6, 1999, City Council received a report, held a discussion and then directed staff to proceed with involuntary annexation of the 83 75 acres described herein, and WHEREAS, the property to be annexed requires a zoning district classification and use designation upon its annexation, and WHEREAS, on June 9, 1999, the Planning and Zoning Commission recommended approval of the proposed Agricultural (A) zoning district, and WHEREAS, on July 20, 1999, the City of Denton involuntary annexed 83 75 acres of land described herein, which was made effective upon its passage, and WHEREAS, the City Council finds that the proposed zoning will be in compliance with the 1988 Denton Development Plan, the 1998 Denton Plan Policies, and the 1999 Growth Management Strategies and Plan, NOW, THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 That the zoning district classification and use designation of the 83 75 acre property described in the legal description attached hereto and incorporated herein as Exhibit A is hereby Agricultural (A) zoning district under the comprehensive zoning ordinance of the City of Denton, Texas SECTION 2 That the City's official zoning map is amended to show the zoning district classification SECTION 3 That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION 4 That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record -Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the J4% day of (, 1999 JACK R, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY BY4" Ir ��4 Z;Z—Ud,) APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY BY / Page 2 of 2 EXHIBIT A A-85 (MESQUITE MEADOWS) 83 750 acres All that certain lot, tract or parcel of land lying and being situated in the Victor Gallor Survey, Abstract No 452, and the Thomas Toby Survey, Abstract No. 1288, Denton County, Texas, and being part of a tract of land described in a deed to Lande Limited Partnership No. 1, filed for record on 10/18/1996, as recorded under County Clerk's File No. 96-R0074752 of the Real Property Records of Denton County, Texas, and being more particularly described as follows BEGINNING at a point on the existing Denton city limits line as established by Ordinance No. 86-07, said point being on the west line of said Lando Limited Partnership No 1 tract, lying approximately 450 00 feet, N 00° 06' 00" W of the southwest corner of said Lando Limited Partnership No. 1 tract, same being 600 feet north of and parallel to the centerline of Loop 288; THENCE North 000 06' 00" West with the west line of said Lando Limited Partnership No. 1 tract, passing the north line of said Thomas Toby Survey and the south line of said Victor Gallor Survey, a total distance of 2495.00 feet to a point for corner at the northwest corner of said Lando Limited Partnership No.1 tract; THENCE North 89a 25' 00" East with the north line of said Lando Limited Partnership No.1 tract, a distance of 1442 40 feet to a point for corner lying 30.00 feet west of and parallel to the centerline of Stuart Road, and the northeast corner of said Lando Limited Partnership No.1 tract, THENCE South 000 26' 00" East, 30.00 feet west of and parallel to the centerline of Stuart Road and the east line of said Lando Limited Partnership No. 1 tract, a distance of 1394.96 feet to a point for corner; THENCE South 00* 26' 00" West, 30.00 feet west of and parallel to the centerline of Stuart Road, a distance of 1141 69 feet to a point for corner on the existing city limits line as established by said Ordinance No. 82-7, said point lying 600.00 feet north of and parallel to the centerline of Loop 288; THENCE North 880 56' 03" West, 600.00 feet north of and parallel to the centerline of Loop 288, with the existing city limits line as established by said Ordinance No. 82.7, a distance of 1448.50 feet to the POINT OF BEGINNING and containing In all 83.750 acres of land A 83 Afews and Bounds doe
