HomeMy WebLinkAbout1999-263F \shared\dept\LGL\Our Documents\Ordinances\99\A 86 Ordinance zoning doc ORDINANCE NO W - a � 3 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, INITIALLY DESIGNATING TO AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 19 8b2 ACRES OF LAND IN THE CITY OF DENTON, TEXAS, LOCATED ON THE SOUTH SIDE OF EDWARDS ROAD, APPROXIMATELY 2,000 FEET WEST OF SWISHER ROAD, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE (A-86, LUBBERS ADDITION) WHEREAS, on April 6, 1999, City Council received a report, held a discussion and then directed staff to proceed with involuntary annexation of the 19 802 acres described herein, and WHEREAS, the property to be annexed requires a zoning district classification and use designation upon its annexation, and WHEREAS, on June 9, 1999, the Planning and Zoning Commission recommended approval of the proposed Agricultural (A) zoning district, and WHEREAS, on July 20, 1999, the City of Denton involuntary annexed 19 802 acres of land described, which was made effective upon its passage, and WHEREAS, the City Council finds that the proposed zoning will be in compliance with the 1988 Denton Development Plan, the 1998 Denton Plan Policies, and the 1999 Growth Management Strategies and Plan, NOW, THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SgCTION I That the zoning district classification and use designation of the 19 802 acre property described in the legal description attached hereto and incorporated herein as Exhibit A is hereby Agricultural (A) zoning district under the comprehensive zoning ordinance of the City of Denton, Texas SECTION 2 That the City's official zoning map is amended to show the zoning district classification SECTION 3 That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SSFCTION 4 That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chromcle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the 9 - day of , 1999 JACI LER, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY BY aigr'llaJ APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY Page 2 of 2 EXHIBIT A A-86 (LUBBERS ADbi I o0N) 19 802 acres WHEREAS, ALAN LUBBERS is the owner of all that certain tract of land situated in the G Walker Survey Abstract Number 133Q, Denton County, Texas and being all of the tolled 10.00 acre tract and all of the called 9 802 acre tract described in the deed from Dons Rae Cowart to Alan Lubbers recorded under Clerks File Number 96—R0069627 of the Real Property Records of Denton County, Texas, the subject tract being more particularly described as follows, , BEGINNING for the Northeast correr of the tract being described herein, at a 1,'2 Inch iron rod found at the Northeast correr of the said 9 802 acre tract and the Northwest corner of a called 21 903 acre tract described In the deed from Doris Rae Cowart to David W Mason recorded under Clerks File Number 95— R00804877 of the said Real Property Records In the center of Edwards Road, THENCE South 00 Degrees 21 Minutes 39 Seconds East along a wire fence with the West line of the said 21 903 acre tract and the East line of the 9,802 acre tract a distance of 132819 feet to a 1!2 Inch Iron rod found at the Southeast corner thereof 3 8 feet North of a fence corner post, THENCE South 89 Degrees 19 Minutes 14 Seconds West with the South line of the 9 802 acre tract passing a 1/2 inch rod found at the Southwest corner thereof and the Southeast corneF of`the"sbTd 11700 acre tract Fond coh iriGing" jsl 'ti5 j4' with the South line of the 10 00 acre tract, in all, a total distance of 646 feet to a 5/e inch Iron rod found at the Southwest corner thereof, THENCE North 00 Degrees 28 Minutes 41 Seconds West with the West line of the 10 00 acre tract a distance of 1336 22 feet to a 1 12 inch iron rod found at tFe Northwest corher thereof on the South side of Edwards Road.
