HomeMy WebLinkAbout1999-275ORDINANCE NO q9� A f AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM SINGLE FAMILY 7 WITH CONDITIONS (SF-7[C]) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION TO PLANNED DEVELOPMENT (PD) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR A 6715 ACRE TRACT OF LAND LOCATED IN THE OAKMONT II ADDITION (LOT 6, BLOCK C) LEGALLY DESCRIBED AS BEING 6715 ACRES IN THE STEPHEN HEMBRIE SURVEY, ABSTRACT 643, IN THE CITY OF DENTON, DENTON COUNTY, TEXAS, PROVIDING FOR APPROVAL OF A DETAILED PLAN FOR THE DISTRICT, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE (Z-99-045) WHEREAS, Timothy May, on behalf of Lloyd Blaylock -Lennox Oaks II, L P , has applied for a change in zoning for a 6715 tract of land from Single Family 7 with Conditions (SF-7[c]) zoning district classification and use designation to Planned Development (PD) zoning district classification and use designation, and WHEREAS, on July 14, 1999, the Planning and Zoning Commission recommended approval of the requested change in zoning, and WHEREAS, on July 14, 1999, the Planning and Zoning Commission recommended approval of the detailed plan shown as Exhibit `B", WHEREAS, the City Council finds that the change in zoning will be in compliance with the 1988 Denton Development Plan, the 1998 Denton Plan Policies, and the 1999 Growth Management Strategies and Plan, NOW, THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the zoning district classification and use designation of the 6715 acre property described in the legal description attached hereto and incorporated herein as Exhibit "A" is changed from Single Family 7 with Conditions (SF-7 [c]) zoning district classification and use designation to Planned Development (PD) zoning district classification and use designation and a detailed plan for the 6715 acres is adopted, said detailed plan being attached hereto and incorporated herein as Exhibit "B" for all purposes, to allow an amenities center in accordance with the comprehensive zoning ordinance of the City of Denton, Texas SECTION II That the City's official zoning map is amended to show the change in zoning district classification SECTION III That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION IV That this ordinance shall become effective fourteen (14) days from the date PAGE 1 of its passage, and the City Secretary is hereby chrected to cause the caption of this ordinance to be published twice in the Denton Record -Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the 17 day of 1999 JAC LLER, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY BY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY BY / `mod .�a '�2 '::: j PAGE 2 EXHIBIT A FIELD NOTES 29260 Square Feet or 0 6716 Acres Denton, Texas June,1998 BEING a 29,250 square foot or 0 6715 acre tract of land situated in the Stephen Hembree Survey, Abstract Number 643, in the City of Denton, Denton County, Texas, and being all of Lot 6, Block C of Oakmont II — Section I, an addition to the City of Denton as recorded in Cabinet P, Page 367 of the Map Records of Denton County, Texas, and being more particularly described as follows BEGINNING at a one-half inch iron rod found at the intersection of the North line of Marquette Drive (a 50 foot wide right-of-way) with the West line of Harvard Drive (a 50 foot wide right-of-way), said corner being the Northeast corner of said Lot 6, THENCE South 03°26'43" West along the West line of said Harvard Drive and along the East line of said Lot 6, a distance of 234 00 feet to a point for corner at the intersection of the West line of said Harvard Drive with the North line of Villanova Drive (a 50 foot wide right-of-way), THENCE North 86033'17" West continuing along the North line of said Villanova Drive and along the South line of said Lot 6, a distance of 125 00 feet to a point for corner, THENCE North 03°26'43" East departing the North line of said Villanova Drive and being along the West line of said Lot 6, a distance of 234 00 feet to a point for corner, THENCE North 86033'17" West a distance of 125 00 feet to the POINT OF BEGINNING and containing 29,250 square feet or 0 6715 acres of land, more or less USAI Project No 98002 8002Lot6BIkC doc SCHEDULED ON DEVELOPMENT REVIEW EXHIBIT B I I I I^ I v I ------------------- I
