HomeMy WebLinkAbout1999-319FILE REFERENCE FORM 99-319 X Additional File Exists Additional File Contains Records Not Public, According to the Public Records Act Other FILES Date Initials Amendd by Ordinance No. 2005-321 10/18/05 JR \\OH LOLWOLWhKadW9p"L\ V SbooNWWA0mai[M\9 99455 MV ORDINANCE NO W -j ! 9 AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING ORDINANCE NO 99- 265, TO PROVIDE FOR THE APPROVAL OF A DETAILED PLAN CONTAINING 2 8 ACRES WITHIN THE CONCEPT PLAN FOR PLANNED DEVELOPMENT 173 (PD-173) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION LOCATED EAST OF FLORENCE ROAD AND APPROXIMATELY 500 FEET NORTH OF CRAWFORD ROAD, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE (Z- 99-055) WHEREAS, on August 3, 1991, by Ordinance the City Council approved a concept plan for Planned Development 173 (PD-173) Zoning District encompassing 2,725 acres of landed, as more particularly described therein, and WHEREAS, Robson Denton Development L L C , has applied for a detailed plan for Planned Development 173 (PD-173) containing 2 8 acres of land, and WHEREAS, on August 11, 1999, the Planning and Zoning Commission recommended approval of the detailed plan, and WHEREAS, the City Council finds that the detailed plan will be in compliance with the concept plan, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 That Ordinance No 99-265 approving Planned Development District No 173 is amended by approving the Detailed Plan attached hereto and incorporated herein by reference as Exhibit "B" for 2 8 acres more particularly described in Exhibit "A", which is attached hereto and incorporated herein by reference SECTION 2 That a copy of this ordinance shall be attached to Ordinance No 99-265, showing the amendment herein approved SECTION 3 All provisions of Ordinance No 99-265 in conflict with the provisions of this Ordinance are hereby repealed, and all other provisions of Ordinance No 99-265, not in conflict with the provisions of this Ordinance, shall remain in full force and effect SECTION 4 That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION 5 That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chromcle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage P WiunlWep"LW 5 um�n9m%\99 49455d PASSED AND APPROVED thus the � day of 1999 JAC LER, MAYOR , ATTEST JENNIFER WALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY 4 i -m-11-ml 1 Page 2 ., EXHIBIT A DESCRIPTION OF PROPERTY Being a 2 824 acre tract of land situated in the T & P R R Survey, Abstract No. 1301 and the W.L. Dunning Survey, Abstract No. 1568, Denton County, Texas, Void 2.824 acre tract of land being a portion of a 2421 5 acre tract of land (by deed) as described by Warranty Deed to Cal Farley's Boys Ranch , and Highland Park Presbyterian Church, as recorded in Volume 2771, Page 967 of the Deed Records, Denton County, Texas, said 2 824 acre tract of land being more particularly de9cnbed by metes and bounds as follows COMMENCING at 5/8 Inch iron rod set for on extenor ell corner in the west line of said 2421,5 acre tract of land, said 5/8 inch iron rod being at the intersection of Crawford Road (a vanable width, undedicated right—of—way) with Florence Road (a vanable width, undedicated right—of—way), said 5/8 inch iron rod also being in said Florence Road, THENCE North 00 degrees '00 minutes 47 seconds East, with the west line of said 2421 5 acre tract of land and said Florence Road, a distance of 481 58 feet to a point for corner, from which a 5/8 inch Iron rod set for an interior ell corner in the west line of said 2421 5 acre tract of land bears North 00 degrees 00 minutes 47 seconds East, a distance of 129 53 feet, said 5/8 inch iron rod also being in the north line of said W L. Dunning Survey; THENCE South 89 degrees `59 � minutes 13 seconds East, a distance of 150.00 feet to a 5/8 inch iron rod set for the POINT OF BEGINNING of said 2.824 acre tract of land.
