HomeMy WebLinkAbout1999-320\\CH LGL\VOLT\SHARED\DEPnLGL\Our Documents\Ordinances\99\Zonnig Definition revisions doe ORDINANCE NO 99-3a(12 AN ORDINANCE AMENDING CHAPTER 35, "ZONING" OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, SECTION 35-3, "DEFINITIONS", SECTION 35-76, "DEFINITIONS AND EXPLANATIONS, AND SECTION 35-301, "OFF- STREET PARKING AND LOADING", PROVIDING FOR A PENALTY IN THE AMOUNT OF $2,000 FOR VIOLATIONS THEREOF, PROVIDING FOR A SAVINGS CLAUSE, PROVIDING FOR A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1. That Article I, Section 35-3 "Definitions" of Chapter 35 of the Code of Ordinances is amended to read as follows Section 35-3 Definitions Apartment means a room or suite of rooms in a multifamily dwelling or apartment house arranged, designed or occupied as place of residence for not more than one (1) family Bedroom unit means one (1) or more rooms in a dormitory, fraternity or sorority house designed and furnished for the occupancy of not more than two (2) students Dwelling, one family shall have the same meaning and effect as the definitions contained in section 35-76 of this chapter for one -family dwelling (attached) or one -family dwelling (detached) Dwelling, two family shall have the same meaning and effect as the definition contained in section 35-76 of this chapter for two-family dwelling SECTION 2 That Article III, Section 35-76 "Definitions and explanations" of Chapter 35 of the Code of Ordinances is amended to read as follows Section 35-76 Defimt►ons and explanations Group Home means a community -based residential facility providing 24 hour care in a protected living arrangement for not more than 15 residents plus 1 supervisor per 4 residents This classification includes homes for the handicapped as defined in 42 U S C Sec 3602(h) SECTION 3, That Article VI, Section 35-301 "Off-street parking and loading" of Chapter 35 of the Code of Ordinances is amended to read as follows \\CH LGL\VOLT\SHARED\DEPT\LGL\Our Documents\0rdinances\99\Zoning Definition revisions doe Section 35-301. Vehicle parking regulations (c) The minimum off-street parking spaces for residential use shall be as follows (2) Multifamily dwellings (d) a One (1) space per occupant for the maximum allowable occupancy of the structure as required by the Building/Fire Code for dormitories, roommghouses, fraternity or sorority structures or other group housing structures (but not including "group homes" as defined in this chapter) b One and one-fourth (1 25) spaces for each efficiency unit c One and one-half (1 50) spaces for each one -bedroom unit d One (1) space for each bedroom for each two -bedroom or larger unit e In addition to the requirements of this paragraph, subsections a through d , each multifamily dwelling must provide for visitor's parking one space for every ten (10) bedrooms, except a multi -family dwelling with less than 50 dwelling units and comprised exclusively of one -bedroom dwelling units (30) Group home One (1) space for each employee and one (1) space for each ten (10) residents A circular drive that will adequately serve the same traffic load, approved by the Director of Engineering and Transportation, may be substituted for the required public parking SECTION 4 That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION 5. That the provisions of this ordinance as they apply to Sec 35-3, Sec 35-76 and 35-301, Code of Ordinances, City of Denton, Texas, shall govern and control over any conflicting provision of Sec 35-3, Sec 35-76 and Sec 35-301, Code of Ordinances, City of Denton, Texas, but all the other provisions of Sec 35-3, Sec 35-76 and Sec 35-301 Code of Ordinances, City of Denton, Texas, not in conflict with such amendments, shall continue in force and effect SECTION 6 That if any section, sub -section, paragraph, clause, phrase, or provisions of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not effect the validity of this ordinance as a whole or any part or provisions hereof, other than the part so decided to be invalid or unconstitutional Page 2 \\CH LGL\VOLI\SHARED\DEPMGL\Our Documents\0rdinances\99\Zonmg Definition revisions doe SECTION 7 That this ordinance shall become effective fourteen (14) days from the date of this passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of its passage PASSED AND APPROVED this the day of U 1999 F00f ER, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY BY AP OVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY BY A6�44 Page 3
