AN ORDINANCE APPROVING RETAIL BASE RATE REDUCTIONS FOR TEXAS
UTILITIES ELECTRIC COMPANY, PROVIDING AN EFFECTIVE DATE THEREFOR,
APPROVING A MOST FAVORED NATION PROVISION, RATIFYING AND
CONFIRMING THE ACTION OF CITY STAFF AND THE CITY'S OUTSIDE LEGAL
COUNSEL IN INTERVENING IN PUBLIC UTILITY COMMISSION OF TEXAS DOCKET
NO 18490, FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE IS PASSED IS OPEN TO THE PUBLIC AS REQUIRED BY LAW
THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I On December 22, 1997, Texas Utilities Electric Company ("TUEC") filed
with the Governing Body of this municipality a Petition and Statement of Intent ("Stipulation")
to implement base rate reductions for its retail electric service customers within this
municipality, which base rate reductions are components of a settlement reached among various
parties set forth in the Stipulation and Joint Application for Approval Thereof ("Stipulation")
filed with the Public Utility Commission of Texas on December 17, 1997 in Docket No 18490
SECTION II The said rate schedules implementing such retail base rate reductions are
hereby approved as the rate schedules implementing such retail base rate reductions within the
corporate limits of this municipality until such time as the rate schedules of Texas Utilities
Electric Company may be changed, modified, amended or withdrawn with the approval of the
Governing Body of this municipality
SECTION III. The aforesaid rate schedules herein approved shall be effective beginning
January 1,1998
SECTION IV. The filing of the rate schedules implementing such retail base rate
reductions — being Rider RRD — Residential Rate Reduction, Rider GSRD — General Service
Secondary Rate Reduction, and Rider RD — Rate Reduction — shall constitute notice to the
consumers of electricity, within this municipality, of the availability and application of such rate
schedules The three said rate schedules are attached hereto and are incorporated herewith by
reference,
SECTION V_ Nothing in this Ordinance contained shall be construed now or hereafter as
limiting or modifymg in any manner the right and power of the Governing Body of this
municipality under the law to regulate the rates, operations, and services of Texas Utilities
Electric Company
SECTION VI. Notwithstanding any other provision of this Ordinance, in relation to the
attached rate schedules, the rates authorized for electric service in the City of Denton, Texas
shall not exceed the lowest rates available to residents of any other municipality served by TUEC
finally resulting from TUEC's filing of the Stipulation and any other appeals from City
ordinances connected herewith
SECTION VII The concept and methodology of depreciation shifting as advanced by
TUEC, and contained in the Stipulation filed in PUC Docket No 18490 is questioned at this time
by the City Council, which concept might impact upon the ratepayers of the City of Denton,
Texas, resulting in increased costs of electric transmission
SECTION VIII That the City of Denton in the interest of sound public policy has
heretofore intervened in PUC Docket No 18490 on the 15th day of January, 1998, in order to
receive all filings and in order to protect the interests and rights of the citizens and ratepayers of
the City The City Council hereby ratifies and confirms the actions of City staff and the law firm
of Lloyd, Gosselink, Blevms, Rochelle, Baldwin & Townsend, P C of Austin, Texas in filing the
City's intervention in said proceeding on an emergency basis
SSECTION IX It is hereby officially found and determined that the meeting at which this
Ordinance is passed is open to the public as required by law, and that public notice of the time,
place and purpose of said meeting was given as required
SECTION X. That this ordinance shall become effective immediately upon its passage
and approval

Applicable to all customers receiving service under Rate R - Residential Service Rate RLU - Residential Low Use Service Rate
RTU - Resi4leential Tim e-cf-Use Service, and Rate RTU 1 - Residential Time -of -Use Service If the Public Utility Commission has
not acted by March 31, 1998, to approve or reject the Stipulation and Joint Application for Approval Thereof and Request for

schedule by March 31, 1998, the Company may terminate the base rate reductions and all other aspects of the Stipulation than or
at any timsithereatler, upon giving the Commission and the City two weeks prior notice In the event the Commission does not
approve the Stipulation, this tariff schedule will automatically terminate as of the date the Commission enters an order inconsistent
with the Stipulation
The provisions of the applicable rate schedule are modified only as shown herein
Monthly Rate
In accordance with the terms of the applicable rate schedule, except that this amount under the applicable late schedule, excluding
t charges pursuant to RklerFC- Fuel Cost Factor, is reduced by 4% for all billings on or after January 1, ION, and 5 4% for all

Applicable to all customers receiving service under Rate CIS - General Service Secondary and Rate GTU - General Service Secondary
Tlms4-Use Including any applicable riders If the Public Utility Commission has not acted by March 31 1998 to approve or reject the
Stipulation and Joint Application for Approval Thereof and Request for Immediate Rate Reductions (-Stipulat on ) filed with the
Commission in Docket No 18490, and the City has not approved this tariff schedule by March 31 1998 the Company may terminate
the base rate reductions and all other aspects of the Stipulation then or at any time thereafter upon giving the Commission and City two

3.4.18 Rider RD - Rate Reduction
Application
Applicable to all retail customers receiving service under rate schedules other than those to which Rider RRD or Rider GSRD are
applicable If the Public Utility Commission has not acted by March 31 1998 to approve or reject the Stipulation and Joint Application
for Approval Thereof and Request for Immediate Rate Reductions ('Stipulation') filed with the Commission in Docket No 18490 and the
City has not approved this tariff schedule by March 31 1998 the Company may terminate the base rate reductions and all other aspects
of the Stipulation than or at any time thereafter, upon giving the Commission and City two weeks prior notice In the event the
Commission does not approve the Stipulation, this tariff schedule will automatically terminate as of the date the Commission enters an
order inconsistent with the Stipulation
The provisions of the applicable rote schedule, including any applicable riders are modified only as shown herein
Monthly Rate
In accordance with the terra of the applicable rate schedule except that the amount under the applicable rate schedule excluding the
charges puffusent to Rider FC -Fuel Cost Factor, Is reduced by 1% for all billings on or after January 1,19M For Rates RTP, RTP-I
and RTP-I.1 the 1 % reduction Is applicable only to non -fuel related charges for all billings on or after January 1, 1998
