ORDINANCE NO W4Y
AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM THE COMMERCIAL CONDITIONED (C[c]) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION TO THE PLANNED DEVELOPMENT
CONDITIONED (PD[c]) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION
AND APPROVING A DETAIL PLAN FOR A 0 425 ACRE TRACT LOCATED ON THE
SOUTHEAST SIDE OF LOOP 288, SOUTH OF SPENCER ROAD, PROVIDING FOR A
PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF,
AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Mr Mike Kurowski initiated a change in zoning by applying for approval of
a detail plan for a 0 425 acre tract of land from the Commercial Conditioned (C[c]) zoning
district classification and use designation to the Planned Development (PD) zoning district
classification and use designation, and
WHEREAS, on January 28, 1998, the Planning and Zoning Commission recommended
approval of the detailed plan, and
WHEREAS, the City Council finds that the change in zoning will be in compliance with
the Denton Development Plan, NOW THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the zoning district classification and use designation of the
0 425 acres of land described in Exhibit A is changed from the Commercial conditioned (C[c])
zoning district classification and use designation to the Planned Development Conditional
(PD[c]) zoning district classification and use designation and adopting the detailed plan, attached
hereto and incorporated herein as Exhibit B for all purposes, in accordance with the
comprehensive zoning ordinance of the City of Denton, Texas, subject to the following
conditions
1 Lighting shall be of the type and specifications as shown in Exhibit C and is
attached and incorporated herein
2 The only permitted use is that of a retail gasoline station as shown in the detailed
plan
SECTION II That the City's official zoning map is hereby amended to show the
change in zoning district classification
SECTION III That any person violating any provision of this ordinance shall, upon
conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense

SECTION IV That this ordinance shall become effective fourteen (14) days from the
date of its passage, and the City Secretary is hereby directed to cause the caption of this
ordinance to be published twice in the Denton Record -Chronicle, a daily newspaper published in
the City of Denton, Texas, within ten (10) days oflth�e date of its passage

portion of Lot 1, Block 1 of Wal-Mart Addition, an
addition to the City of Denton, Denton County, Texas, as
shown on the Plat recorded in Cabinet L at Slide 311 of
the Plat Records of Denton County, Texas Said 0 425 acre
portion thereof being more particularly described as
follows
COMMENCING at a 1/2-inch iron pin located at the most
westerly common corner between Lot 1 and Lot 4 in said
addition, and being on the southeasterly right-of-way line
of State Highway Loop 288 (a variable width right-of-way),
THENCE South 38 deg 43 min 00 sec East, departing said
southeasterly right-of-way line, and along the common line
between said Lot 1 and Lot 4, a distance of 182 50 feet to
a 1/2-inch iron rod found for corner,
THENCE North 51 deg 17 min 00 sec East, continuing
along a common line between said Lot 1 and Lot 4, a
distance of 87 57 feet to a 1/2-inch iron rod found for
corner at the beginning of a curve to the right having a
central angle of 12 deg 30 min 06 sec , a radius
distance of 185 00 feet, a chord distance of 40 29 feet,
and a chord bearing of North 57 deg 32 min 03 sec East,
THENCE Northeasterly along said curve to the right and
continuing along the said common line between said Lot 1
