HomeMy WebLinkAbout1998-073Z-98-001 ORDINANCE NO 9L - D /.3 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM THE AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION TO THE OFFICE CONDITIONED (O[c]) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 0 316 ACRES OF LAND LOCATED ON THE EAST SIDE OF WOODROW LANE APPROXIMATELY 400 FEET SOUTH OF EAST McKINNEY STREET, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Greg Edwards Engineering, on behalf of James W Simmons, initiated a change in zoning for 0 316 acres of land from the Agricultural (A) zoning district classification and use designation to the Office Conditioned (O[c]) zoning district classification and use designation, and WHEREAS, on February 25, 1998, the Planning and Zoning Commission recommended approval of a change from the Agricultural (A) zoning district classification and use designation to the Office Conditioned (O[c)) zoning district classification and use designation, and WHEREAS, the City Council finds that the change in zoning will be in compliance with the Denton Development Plan, NOW THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION That the zoning district classification and use designation of the 0 316 acres of land d scribed in Exhibits A and B, attached hereto and incorporated by reference herein, is changed from the Agricultural (A) zoning district classification and use designation to the Office Conditioned (O[c]) zoning district classification and use designation under the comprehensive zoning ordinance of the City of Denton, Texas, subject to the following conditions 1 Lighting on the property shall be designed and maintained so as not to shine on, or otherwise disturb surrounding residential property or to shine and project upward to prevent the diffusion into the night sky, 2 Maximum building height shall be two stones, and 3 A landscaped bufferyard along the side and rear property lines shall be required The setback shall be a minimum of ten feet in width and contain a minimum of nine understory trees Bufferyard requirements may be used to meet any landscape requirements SECTION II That the City's official zoning map is amended to show the change in zoning district classification SEbTION III That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SETIC ON N That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record- Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the / day of ' 1998 7 �-;>4 Goo JA C LER, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY BY '. — ( � 10.- ,o APPRCUED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY BY j:fiLf,G,.,,_ / i u/Z Page 2 F \shared\dept\LGL\Our Documents\Ordmances\9M 98 001 doe -14-qg /3y EXHIBIT "A" BEING all Thal certain lot, tract, or parcel of land situated in the Jonathan Brock Survey Abstract Number 55, in the City and County of Denton, Texas, being all of that certain tract of land conveyed by deed from Vincent Barney Cosrrno to Millard F Thorp, recorded under Clerk's File Number 94 R0059500, Real Property Records, Donlon County, Texas, and being more particularly described as follows BEGINNING at an iron rod found for corner in the west line of Lot 1, Block 1, Country Park Addition, an addition to the City of Denton, Denton County, Texas, according to the plat thereof recorded in Cabinet L.
